I'm surprised nobody has demanded you post a copy of the NIP as evidence as there are some on here who are adamant NIP's are never issued for transgressions which fall within the old ACPO guidelines (and per those guidelines you wouldn't be prosecuted for 78mph in a 70mph limit).

Interestingly, on another forum a contributor with many years experience in traffic policing suggested that anyone receiving a NIP in a situation such as yours should challenge it - unless there are other aggravating circumstances apparently they are seldom if ever pursued if the transgression was within the ACPO guidelines.....
I anticipated such a challenge wink

78 indicated is probably about 74 actual, in case no-one else has trotted this particular nugget out yet.
Cruise was set to 80 (indicated); looks like actual was 2mph out.

Just got a NIP through the post for 78 in a 70 last Monday; first one in 15 years. Camera van, Penrith, cruise set to 80. Surprised it's taken me this long to get a ticket tbh!
The only time anyone ever gets booked for less than 80mph on the motorway is there. They must coin it in with that camera van.
See also the M180 (the motorway that time forgot) when Grimsby Copshop are short of pulls that month. My mate's brother got done for 78mph on the 180, it was one of his 4 x 3 points tickets = sending off a year or so ago, he elected to go to court and lecture the madge about catching criminals rather than honest drivers going to work, you can imagine how that went. Still, he's got his licence back now. But 78 will do it if you are unlucky.

bugger. It is usually around 4mph over at those kinds of speeds!! An old school tomtom sat nav unit might come in handy here as they report the actual speed.

Setting the cruise control at 70 would also be effective.

OK this is (I think) the first automated speed camera fine EVER proved on PH to be issued below the 10mph + 2 'margin' - a threshold continually used by the supporters that the system is 'proportional'.

I think we can all agree that thin veneer has been removed. its is indeed a fking scam (on every level).

Not really a scam is it? No one has been tricked into exceeding 70 have they? He said his cruise was set to 80mph so he got caught knowingly breaking the speed limit. Personally I tend to do around 85-90mph on the motorway so I too would have received a ticket and had to suck it up. The rules are the rules and if we knowingly break them we can't really piss and moan when we get caught.

The 10% rule seems fair, allows for speedo issues on older cars and for those of us with newer cars allows us a little grace on top. The speed limit shouldn't be 70 but it is and we all know it so there is no scam.

The outside lane is reserved for German cars. AUDi, BMW, Mercedes and VW Golfs. who's drivers all believe that traffic law doesn't apply to them.

What about range rovers? Or insignias? Never seen either of those in lane 1.

I've just had a NIP for 35 in a 30 in Sunningdale. The documentation is very clear - speed awareness courses are offered from 10%+2 to 10% plus 9 mph for first offence, then points for second offences or speeds above that upper limit.

So to answer the OP's question, if you do UP TO 10% +2 mph (77) you may not trouble the safety camera partnerships, but you will hear from them at 78.

I was wondering about that. Correcting your maths error, the guidance means SAC's start at 79MPH - so what are Cumbria going to offer the poster doing 78?

thanks Dad. Personally I set mine to 75mph, but as this a car enthusiast site, i figured people might want to geek out over it.

I do a lot of motorway driving during the day (outside of "peak") times and the above isn't true.

I set cruise for indicated 75MPH and the biggest problem is the amount of cars going at about, but not exactly or consistently, the same speed. Try and pass someone and they'll gradually speed up. Keep left to let a faster vehicle pass and they'll get next to you, then just sit there.

Wish he'd been around when I was NIP'd, fined and pointed for doing 79 on the inside lane of a nearly empty M6 in Cumbria one sunny Sunday morning not that long ago.
