I was looking on MSE, and saw this post.

A dcw wants to claim on his insurance when he is overtaken, please tell me this is a troll, and we haven't actually got to this low point.

Hello all.

Basically I am just wondering / advise / thought and opinion on the following.

I would like to know how I can go about making a claim for loses / damage / criminal damage which is sometimes done to my vehicle when someone over takes me.

The kind of damage I am talking about is the stone / gravel / debre which flys off from the persons tyres when over taking me and thus causes paint work damage / scratches / indentation and also windscreen damage / scratches on the glass / indentation marks.

The evidence is caught via my dash cam. Overtaking can be seen and with audio can hear the clattering of stones / gravel / debre hitting my vehicle.

Is it insurance job or solicitor or other ? Because frankly I am sick of it.

I wonder if he has tried sueing his car manufacturer for brake dust on his wheels too.

Hahaha, what?

I mean, if it were something like a brick wedged between the tyres of skip lorry flying out and hitting your car, perhaps you'd have a point that it's them being negligent in checking their vehicle before setting off, but stones being spat up by an overtaking car's tyres? Really?

Let him. Any other time insurance company will laugh at him but it will still go down as a claim with the associated price increase.

I was half expecting this to be someone claiming that being overtaken required them to take evasive action and crash. The amount of times I've passed a doddler on a B road too see them suddenly 'wake up' serve about and press every handle they have available to them is pretty ridiculous.

Was pleasantly surprised, at least, even on a non motoring forum, people aren't humouring his st.

That exact thing happened to me a few months ago.

A full house-brick flew out from between the dual wheels of a skip lorry loaded with building rubble on the motorway just as I was passing him at about 80mph.

It smashed into my windscreen right in front of my face showering me with glass, and almost punching right the way through.

Luckily I was wearing sunglasses at the time otherwise I would have had eyes full of glass.

I couldn't believe how strong the windscreen was as the impact was massive.

A couple of mph more or a slightly different angle of impact on the flying brick and I would have taken it square in the face.

Apparently house bricks flying out from between the dual wheels of construction vehicles, tippers, and skip trucks is very common frighteningly enough.

Jesus Christ that must have been terrifying, glad you're OK, I'll be checking the wheels of construction lorries as I pass them from now on! Did you manage to get hold of the company in question, if only to give them a bking?

The answer is "negligence" if that can be proven then you have a chance of a claim

So no chance really. Overtaking is a perfectly normal part of driving. Too many drivers these days think that it's dangerous or illegal to overtake.

MSE is a strange place to be - sometimes far more unusual than PH - at least on here we're all powerfully built company directors/normal everyday folk drawn together by our love of motoring/cars.

On MSE you can have someone posting for years quite normally and then they post something which really makes you question their mental faculty.

The last time I was on there - which was admittedly a few years ago now - their general chat section (Moneysaving Arms or something?) was a real left-wing love-in; there were no benefits cheats, everything wrong with the country was the fault of the rich/the Tories/Rupert Murdoch, that sort of thing.

Of course people have started threads such as Clueless Labour/ Government and immediately have these removed. For the record I am politically apathetic and am too lazy to vote/care who is in power. But you cannot criticise Labour/left wing and nor can you have an opinion on benefits/unemployment.

And you get lots of threads such as: I demand a refund for a TV I've owned for 5 years. I have a disabled son/daughter. As though a disable offspring confers unlimited rights.

Happened to me on the A13 it glanced off the side of my helmet I st myself and no longer ride behind wagons I hang well back or pass asap.

If they really, really, really, really, really, really, really must try to claim against someone, it would probably be the council or whoever maintains the roads for not keeping it clear of stones etc. Good luck with that though...
