Does an offence under the Malicious Communications Act mean that someone can be put on Sex Offenders register?

Isn't the potential offence here the malicious communication and distress, the content is legal?

I've skim read through this thread (after about page 6), but I'm pretty sure he won't end up in jail for this, unless I've missed something? Yes it may be a crime under act number 39393.334 but surely given the circumstances, maybe a fine, maybe a slap on the wrist, maybe even 15 mins of community service? I really can't see him doing time, even if it was intended to be a dig at his mate for fun and games.

^ ditto I cant see much coming of this. Various cases on the net involving people sending pictures of dead babies to mothers and other stuff and they get a slap on wrist or a police caution.

Hold on: a caution is not to be taken lightly. For starters, it's quite literally an admission of guilt, and it will be part of his criminal record.

It's most definitely NOT a "well, whatever makes this go away" option. It may come back to bite him in years to come.

A lawyer above said "get a decent lawyer". As there's potentially years of grief in this, it seems sensible to me.

exactly - cautions are an admission. It can be easy to agree to if you don't actually know what effect this will have.

Maybe I'm overstating the consequences with prison, yeah. Sexual harassment and revenge porn are a hot political issue though, wouldn't be surprised if the CPS wanted to push hard on this and in the event of a guilty verdict, a judge come down harshly.

I don't know if it's a crime you could end up on the sex offenders register for but either way, a guilty verdict here could have severely career limiting consequences.

Can cause issues with going to USA, etc on hols...

See Pete Townshend, who later claimed in a book/PR effort that he didn't really do nothing, he just couldn't face court, and if he did he might have leapt over the dock and killed the prosecutor. (Yes, really!)

The whole anonymous email to a mate he apparently sees every week is creepy.

Also I echo the sentiments of others that it was blatantly more of "HAHA look at your slag of a sister" e-mail with a screenshot of her sliding down a 10" butt plug. Otherwise I cannot see why he'd have a) gone to the police and b) continue to want to press charges after finding out who sent it.

Nothing. He has not heard a dickie off the police. So either they are planning some massive case against him or they are concentrating on murders etc. Or what is most likely that they don't have the resources to deal with this at the moment so it will be dealt with in due course.
Family friend was in the police but has left now. Said the cutbacks made the job untenable. Increased workload and less officers.

He hasnt called them for an update as when he did before (several times) he got the impression he was hassling them. They told him they would contact him when they needed. At the moment the investigation is still open.
