I was once a passenger in a car and the driver was an ex-police class 1 driver. We were heading from Sudbury (Ashbourne) towards Ashbourne town on the A515. We were in a queue of 5 cars behind a tractor and trailer.

The lead car (we were at the back) kept jutting out to make a pass but was too close to see properly and the guy behind him was doing the same. As we approached a layby on our offside our driver said, I'm going to pull in here for 5 minutes as these two are going to cause an accident.

As we pulled in you could see all the way up the road and braaap, off we went and passed the lot - tidy little move really but wasn't the original intension.
This was pretty much exactly the manoeuvre I was musing, albeit with approaching a left hand bend - interesting to see it's been done.

Layby is defined as part of the carriageway i recall so covered under the same traffic order....ie same speed limit as the adjacent carriageway unless specified otherwise.

Part of the carriageway? In that case I imagine using the layby to perform an overtake is 'undertaking', and likely to get us nicked if seen by a police officer.

More of a carpark than a layby as such but I've seen it done here back before all those posts were put in at both ends (I believe they were put in to discourage this sort of behaviour)

I suspect the answer to the OP's question is either "it's the same as the road" or "it's not a road and doesn't have one" and which it is depends on the exact layby in question. It's certainly not something I'd do unless the layby was completely utterly empty and it was obviously safe and whether I might potentially get 3 points for speeding would be rather less of a concern than 6 for careless
