Although it goes without saying that there is absolutely NO substitute for proper paid-for legal advice, and that every case is different and the outcome rests on the merits, if 'your relative' is reasonably intelligent then a quick read through MAP v MFP 2015 could be informative. This case would appear to fly in the face of "normal" equitable decisions. Odd. I suspect (well, would hope) it would be distinguished in order to prevent people disposing of assets etc to avoid their being lawfully divided etc.

We do the simple thing of each paying our 'share' into a joint account for household bills, we can each spend the rest of our 'own' money as we see fit.

I would bet most peoples' thoughts on this would divide depending on whether they were male or female and whether it was the man or the woman who earned the most (assuming a heterosexual relationship, it would really mess with people's heads if it was a gay couple!).

It isn't really fair for one side to line their pockets on the basis that the other side has a higher earning capacity.

Only when one side has surrendered something to facilitate the partnership does a claim to the other's capacity to earn make a convincing argument.

It should have absolutely no bearing on the outcome, although historically women have done far better than they deserve (as the far lower potential earners/achievers) than the men.
