I‘m dual national GB/German.

My wife is Swedish.

Our two kids are dual national GB/Swedish.


In a post-Brexit Europe, will we be able to move to the UK?

I think it’s too early to say exactly what process would be involved, but I’d be very surprised if you had much difficulty. Worst case you would have to follow the path of applying for a visa, but I think it will end up far easier for EU citizens than non-EU. Obviously your kids and yourself have no problems as you are UK citizens.

To put it in perspective I obtained a visa for a non-EU spouse and stepchild. It’s achievable. I wouldn’t recommend the process to anyone, but it’s not impossible as many would want you to believe.

I'm trying to research this too - in both directions as we would like to move to Spain in 4 years or so. But also have option of coming back.

Looks easier to go than come back (unless we come back in less than 5 years but that isn't the aim).

My wife is Spanish, son British (no dual nationality as Spain doesn't do that - at least not now he is 4). It looks like if we leave and don't come back for 5 years plus then she is back to square one.

UK picture seems a bit of a moving target at the moment

Ask an immigration lawyer. Since the contact is likely to lead to future business, their advice (assuming it's possible to answer the question at this stage) will almost certainly be free.

Its far from clear are you suggesting he shouldnt return to the UK?Will something be wrong with the UK post Brexit for instance?Perhaps you are planning on leaving and he cant visit you?

To answer the OP's original question, as a UK passport holder, you will always have the right to come back and live in the UK, as will any of your children who are UK dual-nationals. Your Mrs would be covered by the spousal immigration exception, which effectively means she can come and live with you here, so long as you have a place to live and the means to support yourself.

You and your children have an absolute right to live in the UK. Your wife will need a visa.
