Caught Speeding at 108mph

I am guilty as sin of the above offence.Have received my summons from the police and will plead guilty.
I do work in medical logistics so a ban will mean I cannot do my job and I do have around 250 drivers and staff relying on me as the Ops man.
On trying to send my response I noticed I could not enter my plea online as the Officer has entered my date of birth as the 28-06-2020 which in fact is the date of the offence. Can I use this as a technicality to get off? I know it is morally wrong but there again I have a full clean licence and a criminal free lifetime record.:0)
I know I can speak to a lawyer etc so would like some factual advice if anyone out there has something.

I know it's not helpful, but if you can afford it I'd definitely be retaining specialist legal advice.

I would very much doubt that is an escape loophole wink there is scope now for errors to be corrected...
speak to agtlaw on here - incredibly helpful, and the professional in this field...

your timing though may be bad - the law is being tightened up according to current media reports to meaning that hardship is less of a get out clause

Ooops - you must feel awful at the moment.

My uncle got caught with a similar misdemeanour some years back. 105mph on the M5. He got a one week ban due to some 'dodgy' mitigating circumstances. But the fine was quite hefty as recompense.

I think your job role would give some credence to a shorter ban. Just be very humble. It will obviously depend on the judge on the day, but.....

Might be worth thinking about being a little more anonymous when asking questions like this on public forums.

Apart from that I'm really not sure if an incorrect d.o.b can be used to avoid any prosecution. As the others says it'd be well worth paying for some legal advice though.

I was told not to rely on the job comment as way of reducing penalties. The Magistrate's view now seems to be, if your licence is that important don't then risk it.
As other have said agtlaw is the man to speak to.

I got done for 106mph some years ago ('98?)on a CBR600F.
Made sure I had representation and apologised for my actions, saying that the road was clear/ I was not annoying any other motorists etc.
Also got a letter from work saying I had to start at 6am and distance and time of the day would have put severe restrictions on me doing my job.

Received £300 fine, 6 pts and two-week ban. (although when I got my license back the court forgot to inform DVLA to put the 6pts on! biggrin)

One of my friends is a firefighter, got caught doing 83mph in a 50 zone. He was told by his boss to not mention his job as a reason for not being banned as it would bring their service into disrepute. He went to court and said he needed to drive the fire engine for emergency response, despite what he was told and still got banned anyway. As you say, if your licence is so important, you should preserve it.

What’s yr job got to do with it? Do you drive for a living and would render your family destitute if unemployment hit or are you saying you drive to the office ?

Agreed.

Coming onto a forum to source specialist to help you is useful.

Everything else is not - you'll just get a load of opinions which right now are probably not useful.

So hands up all those who have never gone significantly over any speed limit? Most times you get away with it, but when you do get caught, just got take the punishment. If Boris got stopped, I don't think he would get off by saying I run the country.

Just to be clear, that story isn't about me, I'm not a firefighter and never have been, nor have I ever been banned from driving.

104 mph in a train of 3 cars here. Rolling road block by 3 motorbikes.... biglaugh

DC, quiet on roads Sunday morning.

Paid £650 for Legal Rep and probably the best £650 I've ever spent. 6 points and a £325 fine. They wanted my licence but there's no way I could have tanken a ban. The Mags were trying to get me to take leave and give me a 7 day ban.

It very much helps having the representation as they can "help" you with the court process and forms, they will know the Mags (pick someone local to your hearing court) and they can speak on your behalf.

Hardship will only come into account if you were to lose your job which would then affect another person (sole bread winner and would mean your partner were to lose their home for example).

Also, they type of road will make a big difference.

When I was researching typical punishments for my case you are much more likely to get a ban on a Motorway than a DC. As strange as that sounds.

No, Boris would get one of his cronies to “investigate” to establish that he wasn’t breaking the law.
A scrote who doesn’t stand by his own children is not a person to be held out as a good example.

Be careful trying to find a loophole - someone I know got clobbered at 92 on the M4 a good few years back. He fought back in the courts, because it was a camera van, and the warning sign wasn’t displayed in accordance with the rules.

They had to let him off the speeding charge - but they combed through everything and found he hadn’t filled in his details correctly on one form or another, so fined him heavily for that.

This wasn’t me, although it’s very ‘asking for a friend’. If you try and get off on a technicality, you can bet they’ll start finding one on you...

I was in court for 115mph, North Yorkshire. Walked away with 6 points and a fine.

I had legal representation prepare everything for me and doing the talking on the day. It wasn't cheap but what price can you put on not having your license?

PH member AGT Law deals with this kind of stuff and usually offers good advice.

Never seen triple digits on the speedo since!

If you intend on pleading guilty, instead of looking for loopholes maybe get one of your drivers to drive you around as and when necessary for the duration of a ban.
