I would like to think the police would have a dim view of the car tootling along in the right hand lane, pure stupidity.
Like middle lane hoggers on motorway, completely ignorant that they are doing anything wrong

Many of them don't even unfold them from the parked positions.
Yes actually. I flash people who are lane hogging and about 1 in 2 will move over. I think they just sort of zone out a little. Works best if you do it from a reasonable distance rather than screaming up behind them and flashing their bumper.

honestly 10 miles? Your almost as bad as the 45 miler!

I will give it a minute and hang back, if they don't move then indicate and pass in the inside.

While passing on the inside i would duly oblige with the 5 fingered salute and be on my merry way feeling satisfied with my actions (said tongue in cheek btw) before I get lambasted!

As has been stated many times, undertaking is not illegal per se. However, you could be charged with another offence depending on the circumstances. In the OP's scenario, it is often the case that if you move over, so do they - and then you overtake. However, if they do not then you will have to use some judgement as to what is best to do - stay where you are, decide to undertake wherever, undertake where there is some room such as a nearside empty slip road etc.

If you are in America, then just pass as you see fit.

I find moving over to the left (UK) sorts it out more often than not.....

After an initial look up the right hand side of the car in front from behind, I usually hang there for around 10 seconds.
There will be a spurt or two of distance closure and full movement to the right of the car in front, to show intent..
After that, I will usually pass on the inside depending on circumstance whilst keeping a full eye on their steering wheel angle.
Usually, there is little or no acknowledgement of the driver that has been passed on the inside and I am sure that is a continuing trend that we will all see the counter effects of for many generations of drivers to come.

So... last night I was pootling along at a steady 70mph wink when two VW Golfs pass v.fast, one hanging off the others bumper. Golf at the rear turns off to next junction and the leading one drops back to 60-65mph continuing in lane 2. I catch up and pull out behind him. He continues for a couple of miles determined not to move over so I drop back to lane one and keep my distance as I'm suspicious of his intent. Motorbike catches up and tries to move him over before attempting to overtake in lane 1. Suddenly both vehicles disappear into distance at high speed. Obviously just some lout looking for a race.

Usually one person undertaking them will do the trick and wake them up and they move over. If it doesn't, they aren't going anywhere and are happy in their lane, so join the long line of illegals and get past the dopey tt on the inside. smile

Talked to a traffic cop friend of mine years ago on this subject. He said there is absolutely nothing wrong with overtaking on the left as long as its done in a controlled manner which applies to all overtaking really.

Get it all the time around my way as we have a mixture of 50mph dual carriageways and 70mph ones. Come across a few people who seem to deliberately sit in the outside lane of the 70 ones doing 50 and then swerve to block anyone who tries to overtake on the left.

Bit different, but we were on the smart M3 earlier and people seem determined to sit in the 3rd of 4th lanes, even if the inside lanes are empty.

I was on the M40 last year, it was fairly quiet and I came up behind a couple of Discovery's in lane 3 with an empty lane 2. I sat 2 seconds behind for a minute or so and waited for the first one to move over and let the second one and me pass but nothing. The guy in the second Discovery didn't seem to be in any hurry to pass the other one ahead of him. I checked mirrors and moved into the middle lane for a double check that there wasn't a car ahead that I hadn't seen. With that the 2nd Discovery, the one directly in front of me, moved left in his lane and closed the gap to the one in front. Great! I thought, he's trying to get past him, I'll wait for him to flash him out of the way and I can pass him too. I resumed my position behind them in lane 3. Waited for another minute and still nothing. Starting to get a bit frustrated now I put my right indicator on and closed up to around a second behind them. I then notice the passenger turn around and look at me, then reach down to the centre console. It was at that point the reversing lights of the Discovery directly in front of me started flashing blue. I dropped back.

Thinking back I wonder what the outcome would have been if I had not been so patient and just sailed past in the empty middle lane. Good job I didn't go for the obvious method of a fist full of main beam and a high closing speed.

Probably wished to go faster/overtake the one in front of them but didn't want to undertake them.
