so he is due to be sentenced today but is refusing court (brother of the bomber who aided him).

Apparently force can not be used to make him attend.

Part of me thinks when you are found guilty even if you did not (as is your right) answer any questions you should have to face justice and that means hear what the judge has to say.

I think its sad we can not have him brought to court to face the music so to speak.

Interesting that they can be tried in absentia, but cannot be sentenced to imprisonment in absentia. Probably something that goes back to Magna Carta, so not something to throw away for a hard case.

IANAL, but would be fascinated to hear why this persists, especially where the defendant has chosen this as a means of protest.

They can be sentenced in absentia, but he has to waive that right. It just needs to be formalised. But he was already in the court building so it's caught everyone out and will cause a delay.

They should throw a rope around his neck and drag him to the court room. His actions are an insult to justice.

On presumes he's in custody generally so hey ho. Let him dig in as much as he wants. Same outcome. Possibly a better outcome if he wants to dig in for the rest of his days.

Oddly enough, I think his actions are a compliment to our justice system, as it has evolved through thoughtful revisions, but always keeping the big picture in mind. Hate filled extremist, yes, and obviously with no manners, but the fact he CAN do this is important.

Understood...

Though if they ever thought they would get any sort of solace from seeing a scumbag like that sentenced, at best it was wishful thinking sadly.

As frustrating as this is, I have to agree.

So what do you suggest we do with asylum seekers?

It does say a lot about our system. I would like for ot to be the case that once found guilty you have to hear what is said to know why this is being handed down.

There are issues hear if the prisoner is violent in the Dock or distresses the family more etc but its one time I would happily see someone if needed brought in, in restraints to have sentence past.

Nothing at all you cant sail from Libya to the UK in a small dingy and although they are allowed to claim asylum we can say no.

All the idiots out there saying Refugees Welcome need to be aware of what they are actually saying and the likely issues this may cause.

Its been delayed till tomorrow now.

I don't see the point in reading out all these victim statements or letting them have their say. He killed 20+ people just give him a life, no parole sentence and stop wasting any more of the courts time. Theres nothing that can be said for him in mitigation and the sentencing should be a formality.

Sounds better than Asylum Seekers welcome.

Unless you are arguing over the legal technicalities to the average person in the street they are the same.

Because there was evidence that he participated in the planning and preparation of the attack. He's just as much to blame as his brother that detonated the bomb.
