I actually can't remember where it came from. I think possibly from an episode of the Weird Science series in the 90s? I think it's supposed to be some kind of hairy gnome-type river-dwelling creature or something.

Buzzard - it seems on the face of it that you have a very good claim for an Employment Tribunal with regard to unfair dismissal, breach of contract, unlawful deduction of wages, and breach of the National Minimum Wage Act.#

However, with the greatest of respect, I don't think you've got enough understanding of these issues to run a claim on your own or even to make an informed decision about whether a claim is the right thing for you to do.

Get some proper (free) advice either from the CAB or from CLA Direct on 0845 345 4 345 and have them help you with the forms.

When you received your wages, did you get a payslip detailing tax paid or any NI contributions ?
If you have, i would call the inland revenue to check he's been paying it on your behalf.
I suspect he hasn't due to what you said about a previous employee, in which case they will also pursue him, and may even have a record of him already.

Get your tools back as soon as possible, take a couple of friends with you as witnesses, let a representative look through them as a good will gesture and also so they cant accuse you of theft later, I hope you kept all your receipts for them filed if you did take that with you.

Dont tell them the password unless they ask.

The courtesy car should have been insured, dont pay it.

Next time someone tries to belittle you with the im bigger and harder routine. Just give them a smile and a wink and say "but their is always someone bigger".

I would defo agree with Odie here that you need to make sure that you have a witness with you when you collect your tools, also co-operate with what they ask of you, it will only look better when they are taken to a tribunal. If they ask for the password give it t them, if they get funny about the tools then leave them there, as long as you have a witness to it all then they really dont have a leg to stand on.
I really think that the best thing to do now is seek legal advice and try to keep contact between them and you to very little or if possible none and ask them to go direct through your solicitor. I have sent you the details via email of my brothers solicitors company that will be able to help you.

Thanks for that I have emailed him.

I went to get my tools the other day and they had broken into my tools box by drilling the lock (which was missing) i don't know what I should do as the situation is stupid!!!!!!!!!!!!!!!!!!!! I don't think reporting it to the police is any good?

I would report it to the police - isn't it their bad behaviour? Surely having a police investigation against them is going to be in your favour at the tribunal? On the other hand you want to appear as reasonable throughout as you possibly can...

Like i put in the other post i would keep all contact to minimum, if you need to get anymore things from there then i would suggest that you ask a family member or friend to get it. When you went to get your tools did you take any photos of the damage or did you have a witness to it? You can phone thew police but all they will do is give you a crime referance number, this would look good in a tribunal so it might be worth doing but it also might not make any difference as a tribunal is only going to be looking at the way they have treated you whilst you where employed by them and leading up to you being sacked, not really much after that.
What you really need ot start doing now find any receipts for tools they have damaged, take photos of all the damage as evidance towards this case. Also you really need to be thinking what you actually want out of this, i.e missing wages, rembursment for tools and loss of wages, distress for all this and most of all compensation for all of this.

HI, sorry for late replay, i managed to get 4 months wages and that was all. Still better than nothing, I have now got a job I love so has turned out all good in the end!smilesmilesmile

That's a great result, nice work. It saddens me to think there are people like your ex-employer out there exploiting and intimidating people.
