His description of what happened before the crash is basically that he was pootling along at 65 and suddenly got knocked off course by a gust of wind. Sure. Tebay is constantly wet (my old house used to overlook J38) and the conditions on the day were described as “horrible”. Standing water was reported and his average speed was above 80, doesn’t take a genius does it!

It was just where the large rocky outcrop on the northbound is. Where water runs down the rockface and across both carriageways during torential rain.

Tough one to call. On the one hand no direct evidence he was speeding or on the phone at the time of the accident. On the other hand it seems highly likely.

Additionally if the conditions were as bad as described then it could still be dangerous driving as he failed to take full account of the poor driving conditions as any reasonable driver would have done.

Either way, I think it will be a difficult jury decision. Of course whatever happens, it won't change the outcome for the people and families involved.

I wonder what the mitigation will be. It needs to be substantial given that: "Morrison had travelled at an average of 81mph for 23 miles beforehand. And . . .had also exchanged 25 mobile phone WhatsApp messages during those 23 miles."

A complete disregard for the safety of others.

Stupidity killed one, seriously disabled another and has had a major negative effect not only on himself but on a number of others.

What a shambles.

I am glad for the families of the Traffic Officers, hopefully they will not be able to move on with grieving and building a new future.

The guilty party showed scant regard for others around them and should face the stiffest of penalties available to the courts, unless of course there was some emergency that meant he had to drive so quickly while messaging people, can't think what that could be though.

Even if his phone wasn't a relevant factor in the collision, it shows how relevant and powerful-a-picture immediate historic use presents to a jury.

Justice has been served for my friends and colleagues. I only served with Paul for a short time, but I had served with Adam since the TO service in Cumbria was launched in 2006. We had worked on the same crew for many years and done many patrols together, the last one being 2 days before the incident. We have lost a fantastic traffic officer and a larger than life character. You can rest easy now mucker. frown

This.

I was very careful about what I wrote prior to the judgement what with this being an ongoing case (which I hope BossHogg didn’t take offence to) and the need to not write anything pre-juridical in these days.

You can write anything you like about an ongoing case so long as you don't write something that risks prejudicing the jury.

Whatsapp - maybe I just don't know how to work it, but I don't think that has a voice-to-text interface - so he must have been typing on the screen and looking at it to read messages?

My brother sends me voice messages that appear as little clickies on Whatsapp, but even if the perp was voice texting that would have absorbed his attention and distracted him from driving.

Whatsapp does have voice to text as well as the ability to record voice and send it. I'm not sure you can do either without picking up the phone though.

Yes, I've accidentally activated the thing to create a voice clip before now. But I mean it doesn't have the equivalent of "Hey Siri, message Fred" or "Hey Siri, read message". It's not a hands free thing.

I assumed not. Whatsapp is all touchy feely, and I suspect that the driver was all over his phone and hooning like an idiot when he lost control. Now he faces jail, and he has shattered the lives of two families as well as harming his own family.

Maybe time for a TV advert campaign about phones and driving, like the ones about drink driving, think bike, slow the fk down in urban areas and so on?

You and your colleagues, and especially his family have my deepest sympathy. No matter what sentence the judge imposes on him the next few years are going to be a living hell for his family. And all because yet another arrogant selfish moron thought the rules didn't need to apply to him.

Not to in any way detract from what appears to have been a thoroughly deserved verdict, but currently, for our sins, the wife and I are driving a Mokka X, this does text, whatsapp and similar completely hands free, the device doesn't even have to be in arms reach, merely cable or bluetooth range.

Dreadful car mind.
