Man jailed for sexual activity with fake 19 year old

He met a ‘woman’ on a dating app who claimed she was 19 (used fake name), he pleasured himself in front of her, she dressed up for him in a body sticking, he took photos and shared them with his mate... he then discovers she was only 12.
He’s now jailed for 2 and a half years and will have life on the sex offenders register.
Seems unjust considering she had lied about her age?

Agreed - it looks like the law needs changing"Under the law there is no defence of mistaken reasonable belief in age when a sex offence complainant is under 13"
My daughter is 11 - a couple of her friends who are over 5' came to a halloween party in makeup, heels, hair etc - could easily have been mistaken for 18+

You genuinely believe that an 11 year old can be mistaken at close quarters (I.e. not over a computer screen) for being aged over 18 ?

Just like Police officers always seem much younger

These were girls who, with a bit of makeup and dependent on clothing could have easily passed for 18+, right up to the point where they opened their mouths, when it became obvious that they were just nice, pretty innocent young girls.
If he genuinely believed her to be 19 (and there is nothing in that report to suggest that was not the case) then he is damned. Mugshot on the internet, hefty sentence and post conviction monitoring, story cached and archived until time immemorial. Of course, the girl's identity will never be made public so there will be no assessment of whether or not he was genuinely fooled. The article really sticks the boot in, repeatedly referring to 'the child' rather than 'the girl'. Since we'll never get the full facts of the case and the finer detail from which we might make our own informed assessments of whether or not this bloke was genuinely convinced she was 19, there isn't much more to say on that.
One might propose an argument of 'oh, but how would a twelve year old pass for a nineteen year old, you'd know she wasn't nineteen after speaking to her'. Well, I'd wager there are more than a few genuine nineteen year olds out there who could easily be outwitted by a 12 year old.

Seems fair to me the law is the law. Nearly 30 and messing about with young girls, thought she was at least 16, yeh right. A nonce off the street is always good.
So you know better than the judge who heard the case, do you? The article reports the judge as saying that he had accepted, in deciding sentencing, that Hodgson "thought, and on reasonable grounds that she was over 16".From reading that, I suspect that if she'd been just a few months older, he may well have been found not guilty, but because she was under 13, even though the judge accepted that he thought she was over 16, that's not a legal defence.
It does seem a pretty unusual case...

I agree. And I certainly don't agree with the poster who said it gets harder to judge girls ages as you get older. As you get older you get more experience of children in the family or children of friends and are at least as good at working out a persons ageKermit power said:
Eleven is maybe pushing it a bit, but I remember dropping my daughter and a couple of her friends off for a school residential aged no more than 13 at the very most, and realised whilst picking up bits and pieces for their coach journey that I was shorter than either of her friends. I'm 5'10.

Your last sentence sums it up I think. Even 16 year olds can seem pretty naive but a 12 year old cannot but act like a (precocious) child surely? These were girls who, with a bit of makeup and dependent on clothing could have easily passed for 18+, right up to the point where they opened their mouths, when it became obvious that they were just nice, pretty innocent young girls.

He was still 28, so even if he thought she was 16, still creepy and perverse. From reading that, I suspect that if she'd been just a few months older, he may well have been found not guilty, but because she was under 13, even though the judge accepted that he thought she was over 16, that's not a legal defence.

And no way he spent any time with 13yo and mistook her for 19. Maybe in passing only would that br possible. Or wilful ignorance.
I am both old and not all that good at women pulling...although not completely hopeless
However is it really that hard not to chuck your load immediately, perhaps he should have waited for the second date!
I'll be teaching my son to follow Vincent Vega's advice, go home have a wnk and that's all he's going to do.
God knows what I'll do with my daughter....

I have a 25yr old too
In heels they were around 5'5" fully made up - I was shocked and thankful they weren't my daughters.
I'm not saying all 11 yr olds can look 18+ but some can, similarly some start periods etc as young as 7 !
