In other Swamp news, trump has paid his $2m fine

President Trump has paid $2 million in court-ordered damages for misusing funds in a tax-exempt charity he controlled, the New York attorney general said Tuesday.

The payment was ordered last month by a New York state judge in an extraordinary rebuke to a sitting president. Trump had been sued in 2018 by the New York attorney general, who alleged the president had illegally used funds from the Donald J. Trump Foundation to buy portraits of himself, pay off his businesses’ legal obligations and help his 2016 campaign.

The money was split among eight charities, according to a statement from New York Attorney General Letitia James (D). The charities were the Army Emergency Relief, the Children’s Aid Society, Citymeals-on-Wheels, Give an Hour, Martha’s Table, the United Negro College Fund, the United Way of National Capital Area, and the U.S. Holocaust Memorial Museum, according to the statement.

trump also lost in court again yesterday.
A federal judge in El Paso has blocked the Trump admin's plan to pay for border barrier construction with $3.6 billion in military funds, ruling that the admin does not have the authority to divert money appropriated by Congress for a different purpose.

trump caved in and gave the Democrats most of what they wanted in the trade deal with Mexico and Canada, as trump is desperate to have some success he can tout on the election campaign.

McConnell wasn't happy with it
The Senate will take up Trump's renegotiated North American Free Trade Agreement only after an impeachment trial concludes in the chamber, Senate Majority Leader Mitch McConnell said Tuesday.

"We will not be doing USMCA in the Senate between now and next week," the Republican from Kentucky said at a news conference on Capitol Hill. "That will happen, in all likelihood, right after the trial is finished in the Senate."
McConnell also said the renegotiated trade pact is "not as good as I'd hoped," differing with White House press secretary Stephanie Grisham, who said in a statement around the same time that the final version of USMCA is the "biggest and best trade agreement in the history of the world."

Barr meanwhile has gone full in witrh trump, rejecting the findings of Horowitz's report into the FBI actions

In a NBC interview he continued to push that Obama wiretapped trump,

NBC News interview: “I think, probably, from a civil liberties standpoint, the greatest danger to our free system is that the incumbent government used the apparatus of the state — principally, the law enforcement agencies and the intelligence agencies — both to spy on political opponents. But as to use them in a way that could affect the outcome of the election. As far as I’m aware, this is the first time in history that this has been done to a presidential campaign.”

“I think our nation was turned on its head for three years based on a completely bogus narrative that was largely fanned and hyped by a completely irresponsible press. I think there were gross abuses . . . and inexplicable behavior that is intolerable in the FBI. There was and never has been any evidence of collusion, and yet this campaign and the president’s administration has been dominated by this investigation into what turns out to be completely baseless.”

All of this was rejected by Horowitz’s report

trump held another rally last night, seeking support from his base.

He slurred his way through a lot of it, offered even more lies, again attacking Lisa Page

Trump spreads unsourced rumors about Lisa Page taking out a restraining order on Peter Strzok: "Did I hear he needed a restraining order after this whole thing, from Lisa? That's what I heard. I don't know if it's true."

Hershey, Pa. — Tonight is Trump's first rally since his campaign banned Bloomberg reporters from attending. But —for now — the policy seems loosely enforced. The Bloomberg reporter in the WHCA pool arrived on Air Force One, and is currently sitting w the rest of the press pool.

At the rally trump called Congressman Adam Schiff "a crooked bd."

Yup cos it was the Adam Schiff Foundation that had to cough up $2M today for crooked practices... oh wait

Giuliani news.

Rudy Giuliani and Judith Giuliani were set to go to trial on their very public, very ugly, divorce. Then suddenly, they settled.

“They wish each other the best of luck," her lawyer said.
https://www.nytimes.com/2019/12/10/nyregion/rudy-g...

Pretrial proceedings revealed the couple’s $230,000 monthly spending, which enabled $12,000 splurges for cigars and $7,000 for fountain pens.

What is it with team trump and their extravagant spending habits?

Questions asked about where the money came from.......

I’ve watched US media for a number of years and have to say that they must take some responsibility for the mess the US is in these days. By this I don’t mean the right wing / left wing split which many cite (though I’d characterise it more of a right / mainstream centre / left 3 way split).

My problem with the US media is their seeming inability to properly interview and interrogate their political representatives. They all seem very good at sitting around a table in front of a camera and criticise what’s going on but when in an interview they let politicians spout all sorts of bull and barely challenge what’s being said.

I don’t see any US journalist that is a patch on Paxman, Marr, Niel et al at pushing back at false statements / lies etc. Imagine the YouTube clips if Paxman were to go to town on Barr or Graham...

'many people' have pointed out that when previously backed into a corner, trump had meetings with Putin, that sudden trip to Asia, the talks at the G7 etc, or meeting his representatives. On the day articles of impeachment landed, of trumps attempts to get further foreign interference into the election, trump schedules another meeting seeking instructions.

Sen. Mike Crapo (R-Idaho) on Tuesday blocked an attempt by Democrats to pass legislation meant to prevent Russia and other countries from interfering in elections.

Crapo's move came after Sen. Chris Van Hollen (D-Md.) asked for consent to pass the Defending Elections from Threats by Establishing Redlines, or DETER Act. Van Hollen argued the bill would underscore that there would be a "very tough price to pay" if Moscow meddles in U.S. elections.

"It's designed to send a very clear and simple message to Russia or any other country that is thinking about interfering in our elections and undermining our democracy that if we catch you, you will suffer a severe penalty," Van Hollen said.

Van Hollen and Sen. Marco Rubio (R-Fla.) re-introduced the bill earlier this year. It requires the Director of National Intelligence (DNI) to determine whether there was any foreign interference in federal elections and impose sanctions on any nations found to interfere.

Specifically, if the DNI determines that Moscow meddled in U.S. elections, sanctions on Russia would have to be implemented within 30 days of the determination.

Justice Department IG Michael Horowitz on the FISA Report "We found that crossfire hurricane was opened for an authorized investigative purpose and with sufficient factual predication"

c-span have the whole testimony and responses. All in all it'scompletely blown allof team trumps defences apart.
https://www.c-span.org/video/?466593-1/justice-dep...

Senator Leahy’s line of questioning prompts Horowitz to say that none of what he found undermines the remainder of the Russia investigation, other than the Carter Page FISA—a real blow to Mike Flynn’s sentencing gambit.

Horowitz says he’s still investigating the FBI New York field office, for their leaks to Giuliani. Leahy asks about leaks to Giuliani during campaign from FBI NY field office to damage Clinton.
Horowitz: we were very concerned about that. we are investigating those contacts. we have other investigations ongoing. hard to prove substantive content of conversations, can prove the contacts.

Papadopolous doesn't have a leg to stand on

Lindsey Graham: "It was the Russians, ladies and gentleman, who stole the Democratic National Committee emails, Podesta's emails, and screwed around with Hillary Clinton. It wasn't the Ukrainians. it was the Russians. And they're coming after us again."

Dianne Feinstein: "This was not a politically motivated investigation. There is no deep state. Simply put, the FBI's investigation was motivated by facts, no bias."

FEINSTEIN: You didn't find a deep state conspiracy against candidate or President Trump?
HOROWITZ: As to the opening, we found no bias, no testimonial, documentary evidence on that.
FEINSTEIN: Did you find any evidence that President Obama or anyone else in the White House asked the U.S. government to investigate then-candidate Trump or his campaign?
HOROWITZ: We certainly didn't see any evidence of that in the FBI's files or the Department's files.
FEINSTEIN: You found no evidence that the decision to use confidential human sources was motivated by political bias, is that correct?
HOROWITZ: Correct.

KLOBUCHAR: "Does anything in your report call into question the finding in the Special Counsel's report that the Russian government interfered in the 2016 presidential election in a sweeping and systematic fashion?"
HOROWITZ: "No, it doesn't."
KLOBUCHAR: Does anything in your report call into question the assessment by FBI Director Wray that Russians' interference in our elections is ongoing and that it's interference in the 2018 midterms were "dress rehearsal" for the 2020 elections?
HOROWITZ: "No, it doesn't."

Rick Gates is still ongoing.
In sentencing memo, he admits "he assisted Mr. Manafort in some of his criminal activity ... & engaged in unlawful conduct on a much smaller scale for his own benefit."

His cooperation was "part of his continuing effort to make amends." and of course he's asking for a sentence without prison time as he's spent 500+ hours with the special counsel's office and other prosecution offices.

Looks like prosecutors agree with Gates, sending messages to others?

Federal prosecutors on Tuesday backed a bid for former senior Trump campaign official Rick Gates to receive a sentence of probation for his crimes, citing his “extraordinary assistance” cases that led to convictions of other associates of President Donald Trump.

Prosecutors said they will not oppose Gates’ request for a non-prison sentence as long as the former Republican consultant and lobbyist continues to help them with investigations, according to a filing in U.S. District Court in Washington, D.C.

Prosecutors noted that Gates, who is due to be sentenced Dec. 17, continued to cooperate with special counsel Robert Mueller and investigators even after receiving “pressure not to cooperate ... including assurances of monetary assistance.”

https://www.cnbc.com/2019/12/10/prosecutors-back-p...

Pardons and payment of legal fees were touted to Manafort and Gates, yet none was forthcoming, in fact Gates dropped the team trump legal team, which is probably the difference between him and Manafort, why Manafort is in jail and suffered huge asset seizure
“Manafort told Gates there were two funds out there,” the FBI document said. “The first was called ‘Patriot Defense Funds,’ and it covered White House staff. The other fund would cover anyone outside of the White House, and Manafort and Gates would be ‘No. 1 and No. 2 on that list.”
“We’ll be taken care of,” Manafort told Gates.

Former federal prosecutor Elie Honig said that this kind of offer should have prompted criminal charges.
“Holy crap. According to federal prosecutors, Gates was promised ‘monetary assistance’ if he did not cooperate? By who?? That’s a lay-down-your-hand obstruction case,” he tweeted.

Parnas faces additional charges and Prosecutors have asked a judge to return Giuliani associate Lev Parnas to jail for lying about his income and concealing a $1 million payment he got from Russia in September, a month before he was charged.

"Parnas poses an extreme risk of flight."

It's rather looking like Russia was bankrolling the Ukraine extortion plot.

Rudy Giuliani’s associate Lev Parnas got $1 million from an account in Russia in September, a month before he was charged with conspiring to funnel foreign money into U.S. political campaigns, according to U.S. prosecutors who asked a judge to jail him for understating his income and assets.

“The majority of that money appears to have been used on personal expenses and to purchase a home,” prosecutors said in a court filing Wednesday. Parnas failed to disclose the payment to the government, prosecutors said.

The payment came the same month that Parnas and Fruman received the first of two requests for documents from Congressional committees investigating the Trump administration’s actions in Ukraine. The pair initially refused to comply with the requests, and were arrested days later on a jet bridge at Dulles International Airport near Washington D.C., as they sought to board a plane with one-way tickets to Vienna. Parnas’s lawyer has subsequently said his client is willing to comply with the congressional investigation.

Pence is playing the obstruction games as well. The House Intel Committee requested that Mike Pence's office declassify supplemental testimony provided by Jennifer Williams regarding Pence's September 18 call with Zelensky.

The Office of the Vice President has not responded to the request.

"Last week, the House Intelligence Committee requested that the Office of the Vice President declassify supplemental testimony provided by Jennifer Williams regarding the Vice President’s September 18, 2019 call with the Ukrainian President, so Members could see further corroborative evidence as it considers articles of impeachment, and provide the public further understanding of the events in question. The Office of the Vice President has not responded to our letter.

"Today, the Committee informed the Judiciary Committee of the classified supplemental submission and is making it available for the Committee’s review and consideration during their markup of the articles of impeachment."
