Grace Millane, a British backpacker was murdered in New Zealand.

The person who is accused of her murder is on trial in Auckland.

The suspect can't, for legal reasons, be named.

I am not asking for him to be named.

Why can't he be named?

It isn't his name that I am interested in, but WHY can't he be named - in a murder trial?

They do it in NZ to ensure a fair trial.

NZ has a law allowing first time defendants to request their name is not made public. The judge can decide whether to grant the request, presumably based on the evidence and ‘public interest’

On the basis of innocent until proven guilty I suppose. Even if found innocent someone who has been named as an accused is likely to have a tough time, seems reasonable not to name to me.

This. The purpose of the rule is to ensure a fair trial isn't prejudiced by having the defendant's name, and then personal details, revealed in the media before trial.

The defendant applied to the trial judge at the beginning of the process to have his name suppressed, but the judge said no. But then the defendant appealed, which meant that his name stayed under wraps until the appeal was heard. Which hasn't happened yet.

It's been widely reported in the media outside NZ though.

Including in The Telegraph and The Independent as far back as last December.

TBH I do think that this isn't the worst idea (ditto anonymity for rape suspects)

The whole thing is very sad, yet another backpacker from a middle class background, who has swallowed the blue pill and naively gone off around the world without a care.

When is this going to stop? How many more need to die?

Totally bizarre - no idea what the reference to the blue pill was meant to infer?

As far as I can recall students have been taking either gap year or end of study trips for generations.

Until you look at cases like the London taxi rapist, who was charged and named, and may well have got off, (as many people accused of rape do), but having been named and his picture released, scores of other women came forward with their accounts of being raped by him.

The conviction rates for rape are stupidly low. It's always going to be tough to prove, because most of the time it's one persons word v another's re consent, and so "beyond reasonable doubt" is hard to achieve. But that means as well as protecting the odd guy falsely accused (which we need to do), loads of actual rapists walk away scot free.

Do we really want to make it tougher to get a conviction?

They have, and quantities of them have been getting murdered in far-flung corners of the world for just as long. I've never understood it myself, particularly the ones who go off completely alone on these sorts of trips.
