VW voluntary termination

Bought a car on PCP with 9k annual mileage allowance over 42 months. Handed it back with 27346 miles on it a couple of months before the final payment. Anyway VW came back said they wanted £1700 as the car was wrecked! All panels needed repainting it was badly internally damaged both interior and mechanics. They finally sent a break down it says they want £1200 for mileage and 500 for damages! There is no breakdown other than that of what the damages were or what excess mileage there was.
So where do I stand? What can I do? They have already taken £400 from my bank

It seems to be a grey area - you can be sure they will ask for it, depends how long you want to fight for.

Just got the contract out for it now and theres nothing in it about mileage or anything! I’ve known people that have had vehicles VTed and haven’t been charged a penny! Even when it’s been repossessed they put my car up for sale with the mileage on a few over what I left so they’ve shot themselves in the foot if they want to say it’s more than what it was

Just wondering, if you hand back the car with a lower mileage, do the finance company offer to pay you?
Would that be an example of an unfair contract term where the penalty only applies when it is in the favour of the finance company?

No. The contract is for up to x,0000 Miles.For me the important question is whether anybody has successfully appealed against the fees being levied by the finance company under VT.
Most agreements state that the car being in a certain condition when you VT and many agreements have an annual mileage threshold. Whether any of this can be enforced is still a grey area from what I have researched..
I have heard some of the fees can be up for negotiation with the finance company when further pressed, however as I recall the language used in these agreements, it suggest that once you have reached the half way point (monetary value) you have no more pay..
My personal experience is that VW FS never used to charge additional fees on VT if say you mileage was over, or a couple of scratches on alloy wheels, however recently in the last 2 years more cases coming up around these charges..

I listened to that radio show and as far as I could tell, the main guy calling in had blatantly violated the terms of his agreement by going over the mileage allowance by something quite significant (I forget the exact number, something like 7,000 miles). I'm all for consumer rights but some people just take the piss IMO.
Mileage is mainly something you need to suck up now, i was over and had to pay up, the amount you talk about is pretty high.
I VT'd my A4 last year , and got called out on some unsatisfactory repairs i'd had done.
What did the BCA report say? They are pretty fair tbh on inspections and I suspect the work was valid, they work within the guidelines set by BVRLA for Fair wear and tear.
And btw if that cost was from the BCA then it will most likely be a fair price I think for repairs.

Update for anyone interested in tracking timescales during Lease VT.
Cancelled with 3 months to go on my VW lease on Monday.
Called BCA to arrange inspection and collection on Tuesday morning.
Inspection is booked for Saturday.
Collection booked for Monday morning.
Pretty straightforward process in the end.
