Lastly, the court order - how does this affect Storey directly? Im guessing he can dissolve RE and start something else? Does this court order not implicate him directly at all?

He's fine, he's not in trouble and I would imagine he has avoided making any personal financial guarantees to creditors if the company (RE) does have to be wound up.

The court order just restricts them from using that logo - and other orders have been stamped since requiring RE to turn over various details to Whyte.

Whyte will have to decide whether to place a large financial claim once they have seen the figures, which could back-fire as that could be the thing that shuts down the company and they will end up with nothing. Or they could agree to let RE sell the cans already produced (however many that may be...) for a high portion of the proceeds going to them, and once the last can with their logo is sold, RE will need to bring in a new logo.

There are endless ways it could play out - but one way or another Whyte will seek the safest way to get as much money from RE as possible, without being so aggressive that the company folds.

Storey came up with a scheme, it didn't go smoothly this time. I'm sure he hasn't put all his personal wealth in to though and will no doubt be back with another scheme if he can't pick up the pieces of this one.

So actually it's starting to become increasingly uncomfortable for Haas then. I can't see how disclosing how much a title sponsor gives the team would be good for when they go to look for new sponsors, or how negotiations with any potential sponsors at the moment.

But, at the same time, what relevance does it have on the copyright case to see how much Rich Energy have given Haas? Can someone explain?

I'm guessing it has to do with determining the assets and the scope of damages. The existence of a few dozen physical cans of the stuff is neither here or there compared to the use of Whyte's logo on an F1 car for a season.

I'd love the outcome to be RE handing over the Haas sponsorship to Whyte for the rest of the season smile

Simplest solution for Whyte is to Licence the logo to Rich Energy,

They are in different market places, selling different things, and they could make a tidy contribution by taking a cut on each can!

oh... hang on.... no sales..... Upfront couple of million and then a cut on each can!

If RE think it's worth X million to get their brand and "logo" in front of a world wide audience then it's going to make it uncomfortable for them to argue that the damages to Whyte shouldn't be substantial in order to reverse that.
