This is why I have installed a dash cam and rear facing cam. There is so much dishonesty these days .... human nature isn't good ... tongue out

Will there ever be a big shake up in the whole car insurance situation?
I argued my corner a few years ago following a bump in which the other driver changed lanes at a roundabout giving me no time to stop.
I argued his insurance and solicitors into silence more than once,all to no avail (50/50),after about a year of arguing,the other driver came up with a statement from a 'witness' that saw the whole thing! No suprise that the witness coud not be contacted for further comment.
How could the other driver not be done for fraud for this?

Seems to be standard these days unfortunately.

I had someone in an X5 reverse into me who despite CCTV evidence tried to say I'd driven into them as well as having the cheek to call me a racist for asking for their insurance details. A driver going right on a roundabout in the left lane smacked the OH's car - they admitted liability at the time then tried to claim he'd hit them instead. That one took nearly two years to sort out as the insurance wanted 50/50 and we refused to accept it. A former colleague actually hit my car in the work car park and didn't bother telling me, fortunately he'd been witnessed doing it by a number of people. When I confronted him, he tried to say he'd only gone off to get a paper and pen. I nudged the bumper of a clapped-out Fiesta at a roundabout, the owner said there was no damage at the time then later decided it needed £600 worth of repairs.

I think the bottom line is that most people are s.

You're right, sadly. I had a couple of non-fault incidents earlier in the decade and both offending parties told blatant lies to their insurers despite witnesess being on hand to testify in my favour. Luckily one was so clearly the other party's fault by road layout - and I had photographed the scene thoroughly, and the other had good witnesses all telling the same story. They persisted with their lies until my photographs were tendered by my insurers and then they caved. The other recent phenomenon is the disappearing witness. I approached a chap in a 5 Series who had been on scene and in full view of the unfolding events, but as I walked to his car he shot off with wheels spinning furiously - no chance of his support then! Once upon a time drivers were willing to support others for camaraderie's sake.

Insurance is a racket that those feeding off it don't want to change. My wife has had two accidents neither her fault. First one young girl in a Mini ran into the side of her in the Jag on a roundabout. Insurance agreed it the young girls fault, car was taken away and merc hire car provided, not asked for. Repair was £2k hire was £3.5k!!!
Several months later young girl puts a claim in for Whiplash, insurance were considering giving in as it was cheaper than going to court, even though it was her fault, go figure that one out.They eventually grew some and nothing happened.
Just before Christmas wife was run into by another young girl in a Corsa. Hit the side of her MR2, she admitted it and signed to say it was her fault. My wife reproted it and within 20 mins of making the call a soliciter was on the phone to handle her claim for excess and damages appointed by the insurers.
My wife has a damaged neck and has had physio which we want covering but nothing else, the soliciter cannot get their head around this as, allegedly, she is entitled to a substantial amount of money and should claim. It goes against our principles but you can see why people lie and cheat regarding accidents as they see it as free money.

I had a staff memeber who had two accidents where he was hit up the back of the van by others. He has had £7k in total for nothing more than a slight bump

No, the standard ph response would be to mention something tedious and irrelevant such as mx5, red bull, sausages in lawn or sponges.

I've had an experience on a different type of road, but with similar results to the OP. The bh only started backtracking and lying after her dishonest father (who wasn't there) had a word with her and re-wrote what happened (a car dealer (yes I know they can't all be like this but I do notice a trend) and I think someone who advertises his cars on here).

I'm similarly as honest as the OP is. An accident that was my fault many years ago was dealt with through my insurance with no argument from me. The staff in the fish and chip shop near me can't count and frequently give me too much change... which I then give straight back. etc

Update!

The saga is still rumbling on. Still chasing my excess, and the other party has only just got back to filing her diagram of the accident rolleyes
Now she says that the accident happened half a mile away from where it actually happened, at an entirely different junction! Moreover, she now claims there were other people in her car to verify her version of events. (she was in fact on her own) I actually laughed out loud when I saw her diagram. The levels of creativity on display are truly impressive hehe

I have spoken to the insurance company again (they had misplaced the pictures that I had sent them!) and they are hoping to resolve the matter in the next few weeks - that will be 12 months after the incident!

Did you have pictures at the scene? Surely you can do something to report her to someone - perverting the course of justice/insurance fraud etc - I'm no lawyer but there must be something that proves her lying that is in some way going to land her in the st?

Lied about you stopping suddenly.
Refused to stop until you caught up with her.
Lied about location.
Lied about people in the car.
Lied about damage.

You have my sympathies - its all wrong.

Insanity. Wouldn't she face prosecution if you can, somehow, prove that she's a bare faced liar?

It's no wonder insurance costs so damn much in this country. I wonder how much in staff time / costs the bill has added up to, for something that should be a simple open and shut case assuming the person who caused the accident wasn't lying?

front of her car hit the back of your car whilst you were stationary. Her fault, 100%, i don't see how insurance can see it any other way.

Might as well claim for whiplash, loss of earnings, depression, anxiety and leading to the breakdown of your marriage (all that is a joke of course).

I'm curious. If these types of 'people' lie in court and then get found out to be lying is that not then perverting the course of justice?

She won't get found out, which is why it's always useful to have an independent witness or have the police attend.

OP - just insist it goes to court and forget about it until then.

I'm still bitter about an incident a few years ago. I was leaving the M3 in heavy slow moving traffic, and about 1/2 mile from the junction started to look to move from L2 into L1 to leave the Mway. I was being especially cautious as I had a young passenger with me. I indicated before moving left, across into a smallish gap in L1, when suddenly a car appeared right alongside and we collided. I'd noticed that the headlights that were in my RVM beforehand disappeared as I started to move over.

When we stopped the first thing the other driver (a prize st and account manager of a well known IT component maker) said was "What made you think I was going to let you push in front of me?". It was quite clear he'd seen me start to move into the gap in front of him and tried to stop me. Unluckily for me my car's blind spot prevented me from seeing him until it was too late.

Needless to say he gave the insurance company a cock and bull story and eventually they decided that "On the balance of probabilities" I'd performed a lane change without proper care. Apart from the excess it meant my insurance policies on 4 vehicles were loaded for the next 5 years and cost me thousands. bd.

I agree it does not work in any policy holders favour, but given that they have to do business with so many people of the type listed on here, I cannot really blame them for taking the easy 50/50 router to a solution. It seems the majority of claims are disputed in some way and if they spend a long time investigating each one our premiums would go up even more.

Back to the OP, I agree that if people were honest it would be firstly a miracle and secondly a lot cheaper all round. But then again that would mean we all have to responsibility for your own actions rather than find someone else to blame. It does not look as if it will happen any time soon

Add g sensor and gps speed tracking to that, and yes, I've got the same.

I was scammed to buggery and back by a white van driving moron a couple of years ago as I had no witnesses, never, ever, will I let that happen again.

Since this is re-opened I'll add my tale of woe. 18 months ago an old woman in a Nissan came across a junction from the right and joined a queue, merging with the traffic proceeding through the junction. Kew Bridge, A205 southbound, junction with A315. Traffic was stationary, but as we all moved off she tried go from a position behind and offside entering the merge in turn to in front, squeezing herself between my offside and the central island. She only got as far as the rear wheel arch before she hit me. Nowhere to stop in traffic, and it's all red routes anyway; half a mile later with her directly behind I pulled over. Of course she kept going, and later told her insurers she was somewhere else at the time with an independent witness (bullst). I sucked it up and still haven't had the trivial damage repaired, but it will cost around £500 in the end. With no witnesses and no CCTV footage it was only ever going to be 50/50 at best, which means I still have to pay the excess so no point proceeding. s, the lot of them.

18 months on it seems my former insurers have sold the details to the ambulance chasers, as my phone is now ringing several times a day with calls from law firms who insist that I can get some money. They've all been told to fk off and the numbers blocked. s, the lot of them.

OP unless you have no reason to change lanes into the lane to the left then sadly its going to go 50/50. Depending on how much money is involved, your insurer might take it to court and let a judge decide but its normally only cases with a large sum of money involved that this will happen.

What the person whose lying is doesn't realise that instead of just her premium being jacked up she's now doing the same to your premium. Even if it goes 50/50 your premiums still get loaded with a jacked up premium.

As someone who deals with liability all day everyday - I would say at least 75% of claims that I deal with "someone" is lying, and the only way to conclusively prove liability is to have a dash cam or CCTV.
