You've binned their goods yet want a refund? Good luck!

Also, spouting consumer law etc etc will get you no where, unless you're a lawyer of course.

Oh, it's THAT one.

Imported built from Ireland in 2014, swapped from Rover to Chev v8 last year, still registered as a 1970 Rover - so hooky free tax - and toys flew out of pram when DVLA's points scheme was explained.

The problem comes with proof. You say the product was substandard and didn't fit. Manufacturer says product was top quality and did fit. Unfortunately neither position can be verified as the product is in the bin. The only other witness to this situation loses all impartiality when he declares the kit poor quality and not fitting, removes it and sells his own bespoke product and service creating a slight conflict of interest. Unfortunately in this case I'd suck it up as a lesson learnt and move on, as without the actual carpet as evidence, the. Manufacturer could equally claim that it fitted perfectly and was made of the finest alpaca scrotum and you can't disprove that.

All that's going on in the world and you're whining that a cheap piece of carpet didn't quite fit your wonky kit car, which you then threw away and now expect a refund for? And you're actually serious !!

Here's some advice; get over it and move on, there are people in the world with much, much, much bigger problems than yours, I mean actual problems, life changing problems. Get some perspective.

oh look at you - so witty amongst all your little macho friends here.

I'll try not to turn your head as I whizz by in our stunning Dax Cobra... you'll find it hard not to notice as I doubt you will ever have seen one quite as impressive as ours... and built all by our own stupid hands!!!! Oh how we will laugh at your surprised little face

We didn't "balls up" fitting the carpet (so eloquently put Sir!)... the carpet was the wrong shape.
Obviously you have never made a mistake in your entire life and always expect and receive perfect goods from perfect retailers and have never received a shoddy product or shoddy service.

We made the mistake of fitting the kit from the outset and the carpet installer threw the old kit away...
I wont make the mistake of ever coming here again for legitimate polite advice.. as clearly its the wrong place to come.

I'm not being witty

You did balls up as you glued in a carpet you didn't want that didn't fit by your own admission, also asking me if i've ever made a mistake implies you know you have made a mistake...so you know what, you're just getting angry because we've all told you what you know yourself, you've made an error of judgement and no, nobody else will pay for it.

I'm fairly sure when you whizz by in in Bonnie I won't give two hoots about your cheapo home build Cobra replica registered as a 1970 Rover. Having spent a lot of time around the real things as a youngster it'll probably offend my eyes, like the rear bumper mounted off centre for instance.

I christened it Bonnie because given your admitted expertise with the carpet I guess every now and again it'll fall apart .........

the parts were from a genuine sealed kit - so I dont think we ended up with something by mistake... and the diagram of contents matched up too.. but it didn't tell you where which piece went.
The parts were not just a few MM out either.. they were utterly and wholly the wrong shapes.... so to use the kit would have ended up looking like a total bodes job of overlapping seams and gaps... We had three people try to work out what went where and all three failed...

It wasn't like trying to do a jigsaw and one piece was slightly the wrong shape... we would have been happy to tweak and adapt it accepting that there are certain tolerances... but more than 50% of the pieces were completely different in shape to the space they were meant to fit...

Unfortunately we simply assumed it WOULD fit - and so started at the front of the car... glueing as we went.. working our way to the back of the car, then finding it all went a bit Pete Tong...

We didn't realise it was a poor grade quality - it was pointed out to us by the Professional who we then employed to do the work again... he said the carpet wouldnt have lasted long and would wear very easily...
Three people- none of which are able to identify 'poor grade quality' carpet (because you clearly need to be a professional to work that out) - try to work out what went where (and all three failed...)
This is because 'The parts were not just a few MM out either....they were utterly and wholly the wrong shapes....it wasn't like trying to do a jigsaw and one piece was slightly the wrong shape... we would have been happy to tweak and adapt it accepting that there are certain tolerances... but more than 50% of the pieces were completely different in shape to the space they were meant to fit...'

That sounds awful. Really shoddy.
Knowing that the pieces dont fit, and lets be fair- three different people have tried to fit it....
I would be inclined to send it back for a refund.
Oh...hang on....

'Unfortunately we simply assumed it WOULD fit - and so started at the front of the car... glueing as we went.. working our way to the back of the car, then finding it all went a bit Pete Tong...'

Thanks for the entertainment.
Honestly, its cheered up a pretty dull night.

As far as I am aware there are two types of Dax Cobra replica, one based on the Jaguar Series 3 or XJs, and one based on the XJ40. The floorpan, tunnel and boot are significantly diffferent across the two typers.

Perhaps the OP bought a carpet kit for one type and was supplied the kit for the other.

Cheers,

Tony

The first thing you need to do is get that carpet back as your position is made much stronger but all is not lost. Even though you might not have the rug, you hopefully have photographic evidence.

I had a similar situation last year regarding ostrich eggs, I sold a load to someone and guaranteed them fertile but asked if they wanted the "consultancy service" which they declined. Had they paid me the £500 I'd have happily told them they were wasting their time and to come back 3 months later and buy eggs that would hatch. But as usual, they knew best. Anyhoo, few months later the wife of the guy who bought them was on the phone to the retailer bhing away and threatening to sue, after all I'd guaranteed them fertile. Retailer phones me for advice.

I stated the following. The eggs were sold guaranteed fertile, not guaranteed to develop or hatch (as stated in the sales email I sent). However if they failed to develop, then that was a good indication they weren't fertile and I'd replace them. One had started to develop but (unsurprising to me) it had died.

I didn't want the eggs back - naturally. Rotten ostrich eggs are corrosive, get that in your eye you'll go blind. But I asked for photographic evidence. She had none. The eggs were gone and it was 6 months later (they had my phone number and should have called 2 weeks later but didn't).

The fact of this account is that I did not need the original product returned in order to provide a replacement. I simply wanted proof. She had none, but refused to accept there was eff all I was going to do about it.

You need the naff carpet back. Failing that, open a good dialogue with the retailer and explain, with photographic evidence. Failing that, take the car round and point out the different rugs, and have the guy who fitted the new rugs phone the shop.

Without the knackered rugs OR photographic evidence you only have good will to fall back on.

Second angle on this, if you paid by credit card, lodge a disputed transaction with the credit card company, the burden of proof is lower. They won't ask for the returned items, simply photographic evidence, if requested. (herein lies the can of worms, you will need to tell CCC everything, if retailer says fine, we want the bits back, you don't return the bits and CCC refunds you, the retailer can quite legitimately come after you for breach of contract (return the rugs for refund))

If the shop won't budge, the original supplier won't budge and the credit card company won't budge then lesson learned.

In these situations, attitude counts for everything, simply winding your ovaries in to a knot and getting all shrill and screechy is in my experience, going to get you nowhere.

Oh and did it not occur to the bloke who was ripping up your rug to actually retain the scraps?

Hope you've done a better job with your measurements elsewhere than you did with that rear bumper. It's mounted off-centre.

Rest of you: try to be a bit nicer to a rare female visitor when she seeks your genuine input... You dont know me or what my life is like and what I could be dealing with
Not going to labour this point, but this is how it'd go regardless, and if you're expecting people to be "nice" to you because you declare yourself to be a woman, hoo boy, time to rip that elastoplast off.

As for your carpet, sorry, I think you're going to be out of luck here. With nothing to return, I can't see any grounds for them to give you a refund. Even Ebay, with their notoriously buyer-weighted policies, would say "tough luck" in that instance.

Now, ask yourself... why would they give you the refund? Would you, in their place? I wouldn't. Indeed, that they would completely refund on return of a cut/trimmed, glued carpet is pretty generous really, there's a strong argument that any such "trim to fit" product comes with an expectation of offering up first, and requesting a refund before any installation work is done.

Not at all, I have my own thread open from last week where I am having an issue with a company myself, and such threads are not in the least bit uncommon. Again, anyone making the posts you have made would receive the same response.

Well, perhaps if you explain the situation to both the carpet supplier and other installer, maybe the former would still give you a refund such that they aren't actually losing money (i.e. refund you down to cost price) and the latter would give you a partial refund of their charges as recompense for nominally putting you in this position.

But I think you'd be very lucky to achieve that, and it would require a pretty skillfully diplomatic approach.

Look, PH isn't going to win any prizes in the Being Really Nice To Everyone stakes, but there are a lot of people here who absolutely know their st, and you can usually get a good/accurate answer. In this case, I'm afraid, "Yeah, and my dad's an otter, no chance sunshine" is that.

You see? This is really useful, pertinent information, and had you asked first - posting a "Why won't this bd carpet fit in this bloody car?!?" thread - it'd have saved you an awful lot of hassle (and possibly cash). Not that it'll do much except rub salt into the wound at this point, but there you go.

After reading previous posts I would think that an ill-fitting carpet is the least of the OP's worries if the car is still registered as a 1970 Rover.

There were two major "balls ups" in this case, both attributable to the person that fitted the carpet:

1) Gluing parts of the carpet in place before verifying that it was all present and correct. A professional really should know better than this, it's always wise to make sure that all parts have been supplied and that they will fit (with minor adjustments if required) before proceeding with an irreversible step such as cutting/gluing.
2) Binning the the glued parts that were subsequently removed.

Assuming the carpet fitter binned the parts without asking you first, then you need to be having a word with them since they have put you into this position.
