Is the driver the guy stood behind the car / in the road on the crossing, or just a random pedestrian?

Either way, quality Darwinism in action there - standing in a road / crossing said road whilst looking down at their mobile rather than what's going on around them.

Nope - the guy is just a pedestrian crossing the road. Car is parked outside some shops - there is actually a carpark just over the road on the right of the pic
