So I parked up in our town to get a kebab!

Notice an old couple parallel parking behind my car, they look way too close for comfort for me so they finish, I walk up to check the back and notice a scrape on my back bumper! It wasn't there before that, I know my car very well!

I walk out and tell them they've hit my car as they try walking away, they deny and tell me I'm chatting st, I told them I just watched them do it, they tell me there sensors didn't go off, I take a look and see my paint on there number plate!

They still deny, my questions is it's my work against theirs, a woman from the local taxi rank further up the road gave me her details and told me she saw it happen too so I have a little back, I've taken plenty of pictures and send them off.

Question is, if I win the claim does my excess still have to be paid, and will I lose no claims as I wasn't even in the car? I'm 22 and to lose my NCB and have the extra charge for the excess would cripple me at the moment!

The scratch is small but not the point in my eyes, the damage was caused by them so should be fixed by them!

For the sake of £30 to chipsaway (or similar) I would just chalk it up and pay it yourself.

Even with a no-fault claim your insurance will go up by a lot more than £30 next year....and you've got to declare this for the next 3/5 years too (and get loaded each time...)

Quote for a localised repair was £160.00 plus vat...

If you tell your insurers about this, your insurance premium WILL rise when you renew. That looks well within the remit of a smart repair, personally I would get a smart repair done and try and recover the cost of it from the couple. Don't involve insurance though.

That's ridiculous - proper bodyshop I assume - try a smart repairer - you'll be pleasantly surprised.

Even for £160 I'd do it myself - my own limit is ~£500.....

Had a BMW 335i at 21/22, was paying ~£850pa insurance.....2 non-fault's (somebody pulled out from a drive into the NS rear quarter and another rear ended when stopped), my insurance went to £2.5k on renewal and that was the cheapest offered - I had to sell the car but had to claim as each repair as '000's

For something that small get it done yourself, by all means try to get the person to pay but if <£100 I'm sure that they'll be far more likely to do so

my advise would be to go here:

You have their registration so find out who they are insured with.

Contact THEIR insurer directly, explain what happened, the fact you have an eye witness and that you have a quote for repair. I can guarantee they would rather sort it out direct rather than you contacting your own insurance.

Once it's all sorted job done. You can say no when asked on quotes if you have had a non-fault claim as it wasn't through your own insurance policy so it wouldn't come up in any searches. Although the PistonHeads Elite will be along shortly telling you in theory when asked you shouldn't "lie" (same as the speed awareness courses...)

Chalk it up to experience, and use the time saved in not pursuing your claim to try and wean yourself off your heavy exclamation mark habit.

If you go to claim they'll tell their insurance company they did nothing at all so their insurance company will fight that for them, likewise yours will try to follow this up and ultimately say if they wont admit liability little they can do, unless you have legal protection then you could maybe take them to court.

Ultimately you might win but it will still be a claim you've logged as a claim made, it will be classed as claim made, but other party at fault. (or something along those lines) That alone being on your file will bump your premiums up come renewal, so if that scratch is the severity of this I'd probably say in the long run you might be out of pocket yourself, even for claiming the right way as your next renewal might increase more than a smart repair.

personally, for how annoying this is (and this is up there with some of my worst pet peeves) it might be advisable to keep off insurance radar for the long run.

We had similar (maybe a little more damage than this) but for the next 5 years we had to mention it as having a claim on our policy, even though it was completely not our fault. Doing the same quote without mentioning this (for example reasons) the premium was roughly £100 give or take less each time.

She contacted her insurance the morning after, they told me not to get my insurers involved and they will sort it out directly so I was sort of forced into having insurers involved whether it was the right thing to do or not.

Have a quick read of that. If you do it outside insurance, by all means don't mention it (though that isn't in the spirit of full and frank disclosure). However, if you are claiming through their insurance, what do you think are the odds that, this time, they wont bother sticking the claim into the database?

Apologies I just don't appreciate others damaging my property and walking away, I get angry when people are dishonest in general.

I'd be hacked off it someone did that to my car.

If you have her address etc, I'd get the work done without the insurance company and take her to the small claims court. I did this once many years ago - successfully - with someone who'd denied reversing into me.

I go there fairly often so I'm sure I can grab one wink
