Surely, if you claimed your neighbour had pissed you off, and you got home and drank a big glass of rum / whiskey / brandy / whatever, when you're already at home.... how could they charge you?

Even if there's testimony you were drinking at the pub, how could they prove you were over the limit when you were driving, if they didn't catch you in the act?
He hasn't actually denied drink driving though has he, said it was a stupid thing to do. Posters on here who don't see DD as an issue are more put out by his conviction than he seems to be.

I think, after reading the article, he was obviously drink driving.

But genuinely - if he staunchly opposed the charges (and had his story straight the first time) could he have gotten away with it?

Again, I'll reinforce my previous statement - drink driving is both indefensible and inexcusable, and the sentence is just. Personally, I'd have liked to see a much more severe fine. He's a very wealthy man. The means-tested fines system should have been much more aggressive in my opinion. £6k to a guy with a £2m house... drop in the ocean. He won't even notice it.

I agree with you, take the chance and deal with the consequences, which he seems to be doing without complaint.

I can’t believe they let him on tv and drink like that
He may have a drink problem but they’ve just made him look a fool and fed his problem
Really was embarrassing to watch... the camera man kept zooming in on his drink glass

Why though? Can you prove that a significant number of incidents have been caused by people with a blood alcohol limit between the English and Scottish levels, or is it just a desire to be seen as 'tougher'?

Because clearly people see and understand that there is a difference between being in excess of a legal limit drawn up based on averages, and being obviously impaired.

I would warrant that most people would, if not actually report someone to the authorities, take steps to stop someone who is clearly impaired from driving - be it by offering them a bed for the night, taking their keys off them or giving them a stern talking to. However I doubt that most of those people would 'drop the dime' purely on the basis of the fact they had seen someone sitting in a pub nursing a pint for a couple of hours.
