The law is actually on your side. It is a criminal offence for a dealer to sell a car withholding iformation .
If the dealer was unaware then it isn't withholding information is it? If all the checks come back clear for the buyer then the same will be true for the dealer checks. The only evidence is facebook, which you cant expect dealers to add to their list of checks.

I obviously need to speak to the police also to see if they have any markers noted against the car, I will try and look for a phone number asap.

It does look like the dealer has to know, but follow the trial back, it was bought off someone. If the dealer did know then the law is clear, an offence has occurred..

op have you got original advert.

The dealer is listed as an AA Gold dealer, therefore part of which should provide 6 months MOT minimum (the car has it's first MOT in July, so only 3 months provided) and should provide history checks on paper also, of which none have been provided.

I haven't as I am concerned he may be friends with the garage owners son/business partner.

Otherwise I was about to yesterday until I saw the stolen car post.

EDIT: reason I mentioned the above is the chap who dealt with me (Father) said it was his son who sourced this car and knew more about it, it's a local car also, so a bit concerned to drop myself in it should I pursue this. When I made my offer he went off to call his son before refusing, but we agreed on a price 500 less than listed, which was offered by them initially rather than a figure I came up with!

Couple of things you could do. Firstly, as you mention, call the Police & ask them. If it 'was' stolen then it surely must have been reported to the BiB.

You could also try running the cars details through Google, perhaps Reg No: &/or make/colour/model to see if anything was reported in the local press such as a theft or accident of some description.

My gut feel is nothing untoward has happened & the original owner was being a be11end on FB & the selling dealer therefore told you the absolute truth. I would push DVLA for an explanation on why the V5 shows 2 consecutive owners as the same person.

I'll call DVLA again in a sec and push more smile

I know I've mentioned facebook a lot, oddly the car I have is listed on the garages facebook page which I have found and the previous owner has been tagged in the post. No comment from him was made however.

Will post back with what the DVLA say this time.

I am happy to keep it, but obviously I feel misled... as I see it I would like to persue one of two options.

1) keep the car with perhaps some financial refund.
2) reject the car based on new found info and request a full refund and return the car.

Idea 1) is most favourable to me.

Do you think I am right to go in and ask for some money back based on my findings? Or am I better rid of this car "just in case"?
Ask for a discount now just seems scammy - either suck it up or return the car.

Is this not just a case of over complicated buyer’s remorse? You were happy till you looked at Facebook.

Perhaps it is but £10500 is a lot of anyones money I guess. Especially to me smile

The DVLA weren't interested at all really on take two. They reeled off a multitude of possibilities and even with provision of the document ref number they said it'd tell them nothing apart from the cars reg etc so to them it's a dead duck and they cannot answer any of my questions.

Ah well.

Exactly.

Truth is, Davros, you have no comeback on the dealer at all. He will deny all knowledge of any theft and recovery even if he knew all along. A post on Facebook means sweet FA. It proves absolutely nothing.

What, exactly are you going to do next?

I've got nothing to lose by going to visit the dealer on Saturday when I'm back up north and ask a few questions without really saying why I am there initially.

It’s what it feels like to me. The excuse of a seller being friends with a dealer is just ludicrous imo and irrelevant as no dealer is going to risk reputation for the sake of what likely will be a minor friendship (if at all)

I guess none of us may know the full facts.

I've called HPI and MyCarCheck and there is no marker recorded against the car at all, HPI were not very helpful but MyCarCheck were very friendly but nothing is listed so that's that I guess.

I just wanted to say I'm not trying to come across as a scammer by any stretch, merely asking for advice. Perhaps it's best not to persue it but to get something out of it see if the garage will cover MOT costs come July seeing as they're supposed to provide 6 months MOT as part of their AA gold dealer promise.

Better than nowt.

Cheers guys.

It seems fairly simple.

You bought a 3yo used car (NOT a "new" one...).

The dealer didn't tell you something which you discovered post-purchase... but which you have no way of knowing whether he knew or not. He can't tell you something he didn't know...

...and there y'go. There's no easy way for him to know, short of trawling social media on the off-chance.

The previous owner said he wasn't getting it back - but he was and did, because the insurance repaired it, rather than write it off.
See this thread - https://www.pistonheads.com/gassing/topic.asp?h=0&... - exact same situation.

You want a post-purchase discount. Something, anything, to make you feel happy. Yet it's the EXACT same car you say you "love", no different to when you decided to buy it. But, apparently, £40-worth of free MOT test will give you a big cuddle and make it all better...?

This bit I don’t get. The car hasn’t got an mot because it’s due its first in July. So the dealer couldn’t give you 6 months mot. It’s your car now, your responsibility. I’d be amazed (and delighted for you) if he drops 50 quid in your pocket.
