It's certainly not very clever - unless you want to nicked for "driving without due care and attention". The argument (from the police's point of view) is that hearing is one of the usual senses a person has -- and intentionally impairing that sense means not being fully aware of the surroundings during driving.
Yes, we know the deaf and disabled can drive. But a complete person would be likely to get get nicked for driving with one leg out of the window.....

Drowning out a noise with a louder noise is called 'masking' and is in fact exposing you to a much louder noise than the original noise. To be drowning Out an engine that would cause hearing loss is likely cutting out all the ambient noises that would potentially avoid a collision
