Urgent help needed please?

Hello,

If anyone can please help I am running out of time... We are in the UK and my friend has received a speeding fine for driving in a different city however she does not hold a driving licence or has ever driven a car as of yet. She thinks she has been named by her ex boyfriend (Who she has not spoken too for 5 years now) of speeding and instead of him giving his name, he has given her name. Now she received a letter stating she owes £355 for a speeding fine which obviously she is not going to pay as it is wasnt her.

She called cambridge (Where the offence took place) and they told her to do a statutory declaration which she agreed to do on the 04/09/2019. She took a day off work and attended magistrates court on the 4th September just to be told she was expected in Huntingdon (City) not in Peterborough (City we are in). She had already told them over the phone she is not able to travel and the court hearing must be in Peterborough so why they made an appointment in Huntingdon we dont know.

My friend got a hold of them again over the phone and they said sorry for the mistake and that they would email her a copy of the next date for a statutory declaration. She has been waiting since but nothing had arrived until 30/10/2019 which states she was supposed to attend a statutory declartion on the 25/10/2019 but did not attend therefore the court has proceeded and held her responsible for the crime and will be charging her the amount of £355 through her work wages. What we dont understand is that we didnt even get an email to say she needed to attend court on the 25/10/2019 so how exactly where we supposed to attend?

Long story short, we have emailed cambridge today stating all of this and showing proof of all emails in and out by us and by the court and now waiting for a response. In the mean time, she received a letter today stating where she works and that the fine order will be soon taking place (Taking money from her work wages).. I know its not a lot of money and we could just pay it and move on but we shouldnt need to as this is not our fault and we are not the criminals here... What are we going to do about this? We will be going to citizen advice bureau today in the morning to ask for advice on this and potentially look out at asking for a solicitor.. Anything else that we can do? Is it even possible to rebook a statutory declaration again or do you literally get 1 chance and thats it?

Why wasn’t she able to travel to Huntingdon? It’s ~20 miles from Peterborough and has a train station?

Unless housebound because of illness or serious disability, your "friend" (if it is you, just say so) could have gone to Huntingdon by train or bus, and it might have been sensible to have done so.

"Asking for a solicitor" doesn't produce one. You can however go and instruct one, or a barrister who does direct public access work.

Your story has many gaps. How did a speeding fine arrive without prior notification of a speeding charge? If nominated as the driver of a speeding car by some disgruntled ex, your friend would have received a form asking her if she was driving.

Why wait from 30 10 to 18 11 to raise a beef?
