Hi guys, so I recently sold my car privately taking another can as part payment. All seemed above board the guy was just looking a little change and seemed decent enough didnt have time to clean the car properly as he had a young family etc. I know, all very gullable on my part.

Anyway, it has now been a week and the car I got has an airbag issue which is going to be expensive to fix as well as an MOT looming soon. I habe found out that the guy I sold my car to actually runs his own car sales garage and is selling the car for considerably more than he paid. I understand that really it was my bad, I shouldnt have been so trusting etc, and I am absolutely livid about the whole thing as the guy told so so many lies right to my face. Anyway, the obvious question is, is there anything I can do? I have the new V5 from the new car and have not yet sent off the one for thw car I sold, but this dosent make a lot of difference right?

It is so infuriating, I guess the lesson is not to trust anyone as this guy is now going to make quite a bit of money on my car that I gave him at a good price because I thought he was in the same boat as me.

What's the Airbag issue?

Why did you take a car in part exchange?

Did you not know the value of your car?

I don't see this as you being scammed, it sounds like you didn't do your checks & you're more mad at yourself than this guy.

Are you a part time dealer? I only ask as I'm not interested in a part ex when I'm selling my cars.

The airbag fault is a problem with the squib so apparently the airbag needs replaced, it also has trouble starting at times and the central locking has a mind of its own. I was told this guy had owned the car for several years and when he had bought it he had done so from a close friend, turns out this was all untrue.

And no im clearly not a part time dealer as I might have been a bit less trusting had this been the case. I took the part ex as I was looking to downsize and get a much more basic car, the part ex seemed lile the ideal solution. Again I know this was mainly my fault so I dont need told that, I just want to know if I have any options as the guy is now not answering my calls.

You did a deal, it didn't turn out the way you wanted...

Can you unwind it? No.
Can you learn from it? Yes.

what car is it, you are better off using the knowledge on here to fix it than trying to get back at him.

Get mate to test drive car, steal it back, leave faulty p/x on his forecourt with the difference he paid in cash inside the car, wait and see what happens?

Its a 2005 Seat toledo, there is no haynes manual available for it and very little information online in terms of guides. I dont think the airbag is a job I could tackle though. But yea I agree I just have to make the best of a bad situation now, I just really hate people telling me blatant lies

The log book would tell you how long this guy had owned the (if the yellow slip is missing from this then that tells you he's a trader) car, so you would have known this as soon as you came to exchange & you could have seen through that lie.

He may be selling it for more money because that's irrelevant (he's prepared to wait longer to hit his number than you were) to the whole thing.

He won't answer nor does he have to, so take it as a lesson learned, sprt the car out use it as was your plan & don't think anymore about it.

Assuming you signed the private sale slip in v5c when you sold your car?

Perhaps DVLA will have an interest if it turns out he's actually a dealer. Maybe the taxman too...

You sold a car to a guy, accepted his car as part ex and now you are annoyed because you have a worse car than before plus the other guy is selling your old car at a profit which is his job.

I presume you undervalued your car and didn't do many checks on the new one.

For what it's worth a seat toledo is largely a mk4 golf so a Haynes for one of those will help

Ask CAB about your rights, although you sold him a car and took one in as a PX, he may still be liable for the problems with yours as he is still moving it on as a trader.
Or there's always the local paper.....

Seeing as the guy is a trader, have you been to his place and told him that you know he's a trader rather than private buyer, and that the car he fobbed off onto you has various issues which you would like to give him a chance to resolve amicably?
Seems like a place to start.
Then you could mention taking a moneyclaim out if he doesn't play ball or help fix the issues.

Yea I know where he lives and I know where he works, seeing him in person is my only real option although I know that will get ugly.

Thanks to all of you that have offered constructive advice, rather than just defending this behaviour as 'his job'. I guess I dont have much choice other than trying to work with what ive got

Yea I am a total bad ass because I have someones address that he told me, whats your point?

Also I have no problem with the guy doing business, but I absolutely hate dishonesty and am even more annoyed by the amount of people on here who seem to pass it off as normal or 'business'
