did you sign something agreeing to their procedures? If not all you have to do is make the car available for collection, nothing more, im trade and i just refund, saves a lot of hassle, I know a lot of places wont touch cars on the register, insurance not sex offenders

Thanks Andy, good to know.

Nothing signed from what I remember, other than standard forms.

I'm trying to be nice about it and make it hassle free, so i'll be driving down tomorrow morning and leaving him with it. He's very insistent that it will require a 2-day independent inspection though and I fear he will just refuse me leaving it with him.
Not sure what to do if that happens..

I wasn't aware you responded to my first reply and only just came across this thread again, after reading through I do hope this goes in your favour.

Now I've seen that he was selling on behalf of a mechanic friend there's no way in hell they didn't know about this, I feel this 2 day long inspection that will realistically take all of 10 seconds to look at is just him pulling the wool over your eyes trying to delay time.

The fact you've let them know you are rejecting it prior to the 30 days ending should suffice for you to still be able to finalise the rejection after the 30 days are up.

Let us know how you get on tomorrow.

Ok, so vehicle dropped off. The manager wasn't there unfortunately... Not sure how that may affect things, but i spoke to his business partner and he told me they would investigate and inspect to ensure the vehicle was road worthy. I assured him, no outcome would give me any more faith and the only thing I would accept is a full refund. I still believe they're genuine, but fear they're going to try and refuse on the basis that it was catd and I knew it had been involved in an accident. That said, i left the key and car and told them I expect a refund.

Guess it's wait and see..

I'll upload photos after of the toilet roll repair.. To clarify, it was stuffed behind the column itself, I assume to stop it rubbing. Not in place of the airbag.

Dude, the law is completely on your side, the CRA is there to protect you as long as you execute it correctly. You have pointed out that you rejected the car within 30 days, you should have kept a record of that and they have responded as well so they were aware that you are exercising your right to reject. Its irrelevant if they have a 2 day check. Car goes back and you get your money. What you don't want to do is start agreeing to all their conditions that are outside of the CRA, you want a refund, fine if they want to check it that's their right - you have photographic and written evidence of the problem. Even if they fix it in the next two days they cannot force you to take back the car as I suspect that is what they will try and do.

Thanks coldel, that's what I told him. I would only be accepting a refund and i was trying to make it easy for them by telling them that and avoiding the 'independent inspection'. I have pictures of today, emails stating I am exercising my 2015 rights and their replies. The only thing I haven't done is issued them with a letter today, but i don't think that matters...?

So just to clarify, is there an airbag there or had it been removed?
From the original post I expected a whole toilet roll wedged where the airbag should live?

Looks like the deployed airbag has been cut out, the clip on the pillar cover has broken/screw pulled through and some bog roll stuffed behind to stop it rattling

begs the question of how other corners may have been 'cut'*

Not that I have seen behind the pillar casing but I would have expected to see the airbag mounted to the actual pillar, not the cover?

BTW OP, I am not in any way condoning what has happened here and don't think it is good form, especially if the airbag has been binned.

There's no airbag fitted, it's been cut - the white cloth you can see in the first picture is what remains.

Might have unintentionally misled with the bog roll.. it's stuffed in the cover, assuming to hide a rattle as someone mentioned. It just appears to be a cheap cover up, I have no faith in the repair job now.

My other concern is; the damage I was shown was outer damage to the front driver side; bonnet, wing and door. The airbag deployed is on the passenger side..

This was the picture I was sent when asking about the CatD - 'Bumper and wing'.

The side airbags are actually rolled up and tucked up along the headlining normally.

Difficult to be sure because of the angle, but isn’t the passenger side wing mirror missing too...?

I see now what you mean and it has certainly been cut out to save costs, how they have managed to keep the light from coming on the dash though is anybodies guess!

After re-reading your original post I don't think it is misleading at all, it does actually make sense so that was a mistake on my part. I don't blame you for not having any faith in the repair job at all, Something like that is just downright dangerous.

Also as another poster mentioned it does look as though the passenger side mirror is missing in that picture, I also have a MK6 Golf GTi and have just stood at a similar angle infront of mine and the mirror is not hidden by the rest of the bodywork. Maybe there is more that they are hiding.

Thanks mate - I hadn't noticed the passenger mirror before, think you're right. All I was told was 'wing and bonnet damage'. The more I see/hear, the more I'm seeing it just as a really bodge repair job and I'm annoyed with myself I didn't look into it more. With the fact it was from a dealership and he told me it was just damage to the panels, I assumed all was ok. Lesson learnt!

Still not heard from the dealer but the car is with them and I won't be touching it again. I'll give them 7-days before sending a letter reiterating my demand for a refund. Hopefully they'll be speaking to the chap they sold it on behalf of to tell him to take it back.

Keep pushing for that refund..... also, for the greater good, I'd reconsider the advice you got from CAB about going to Trading Standards. Typically in situations like this they'll just try and move the car on again to someone else, but more importantly this likely isn't the first or last time they've pulled this trick.
