They have been around for ages, using various eBay usernames and I have nearly stuck bids on a few cars they have sold. They have a lot of rubbish and sheds, but every now and then they have something interesting (RS6, 911, SL Mercs etc) Some pics now are taken at Blackbushe.
They seem like a fair bunch and sell everything "as is" and as said, plenty of people have walked away. Interesting business model - buy at BCA and sell immediately on eBay, must work as they have been doing it for years.

Of course not, but I would imagine they use the usual bullying, intimidating & ignoring methods, to those who do try to complain. Makes you wonder what trading standards actually do? Although most dealer warranties are more useful to wipe your bum on than anything else, hence why IMHO you are better off buying cheaper private & taking your chances, or spend the saving on getting a cambelt & service.J a k e said:

if they are a dealer then by law the have to give a 6 month Warranty. doesnt matter what they say- the law is the law. thats why dealer cars are always more expensive as they factor that in, even if you buy an old trade in it comes with 6 months! james280779 said:

What??No they don't.
I have always assumed that in an auction there is some sort of avoidance of need or obligation to warrant for a dealer. Is my assumption correct? Otherwise how do ADT (appreciate they are an auction house not a dealer) or their clients get away with it as there s definitely no SOGA protection when buying from ADT.
I therefore also 'assume' that selling via EBay (auction not otherwise) has the same effect?
Can anyone with knowledge confirm or otherwise?

In any event, your claim isn't against the auction house, it's against the seller.
SOGA can apply to cars bought at auction, if the seller is selling in the course of business, but usually signage and contract terms at the auction house will make it clear that SOGA protections are limited.
There’s a nice little example on the SOGA website based around a used car being sold with a broken window handle. Basically if the dealer has noted it and even knocked money off in the first place then the customer doesn’t have a leg to stand on if they go back wanting it replaced for free.
Whereas if it was sold without the broken door handle being disclosed then yes the customer would have a case.
IMO that ebay seller does clearly state that there my be faults with the cars which they are unaware of, and upon collection at which point faults are found which weren’t noted the customer is not pressured into buying or even so has a full refund if money has already been paid. Seems quite reasonable and legit to me.

I think that SOGA and warranty laws have some clauses about ‘reasonable expectation’ and ‘cost vs reliability’.
Which is to say; if the dealer is flogging the car as a bargain bucket job that might be knackered you haven’t really got a leg to stand on when it goes wrong.

He hasn’t done a hard sell and told you it’s a reliable car.
You might have some comeback if it turned out to be two cars welded together, if it came up stolen, if it was a cat-c and it hadn’t been mentioned.

Also, without knowing the details behind your post (if this is your field forgive me, I am coming at it from a common sense and some exposure POV) I do t think it makes sense.
Most or at least many cars, sold at auction are sold on behalf of dealers. My understanding is they auction cars they want no come back on. And as for auction house contracts highlighting that SOGA prote tion is limited well that simply won't work. You can't state that a certain law doesn't affect you!
