Just interested in the way the law is currently applied and not disputing the NIP.

My wife was following me in a long line of rush hour traffic travelling at a similar speed and she received a NIP this week for 35mph in a 30mph zone. I thought the threshold for prosecution was exceeding 10% plus 2mph over the speed limit? It was a West Mercia camera van.

Has the threshold been tightened at some point or is the threshold at the enforcers discretion, in which case do they have to apply the threshold consistently or case by case?

That was what she was doing. 30+10%+2 so she wins a prize

Had she been doing 30+ 10% +1 she'd have been OK

Technically 10% + 2 is 35.000.. so if she was doing anything above that, like 35.001 they have met that calculation regardless of any other answer.

AIUI the threshold was always Limit +10% +1 and anything over = prosecution

10% + 2mph is NOT the safe limit. It is the speed at which prosecution generally starts.

35mph is 30mph + 10% + 2, so prosecution will start at 35.

Frequently misquoted on here, unfortunately.

You'd think yourself lucky if you got caught doing 49 in a 30 and got away with 3 points.

Ans conversely a summons for doing 96 on the motorway, think of the children.

Thanks. I checked the tracker on the car and it showed 34mph at the location of the camera van, so I guess she was just unlucky. We’re generally careful, especially in 30mph zones but she was driving my car on unfamiliar roads and in a line of traffic.

She’s not had a NIP for 15 years and none before that in 37 years of driving so not a bad record. She’s been offered a driving awareness course for 1mph over the threshold. Hey ho.

That's the way the system works. Scare good citizens into religious observance of the limits and pray that wild lunatics will somehow follow the same path. As we know, they don't.

Agreed. She’s well aware of the irony of her situation and is taking it really well. I’m sure her speed awareness course will make a considerable improvement to the safety of others on the road (sarcasm).

Always have waze on, saved my bacon a few times. My mate used to setup speed traps and it would clock him before he'd even setup, so he would play it and move around frequently, sometimes showing him in more than one place! hehe

My post was correct because 1mph over the threshold is the same as 5mph over the limit in this instance. So no need for your correction thanks.
