Hit by Uninsured Driver
Discussion
Was out driving today and stopped to give way to a car coming towards me as there was a parked car on my side of the road.
Had a car come up behind me at speed and fail to stop.
Got plenty of photos and his name, address and phone number but no idea if they're truthful.
Checked on askMID and it shows no insurance.
How much is this going to f
k me over now? I'm with direct line and they seem to be okay (online) about Uninsured accident claims and I assume I should be reporting it to the police?
I also have details of a witness (the car I was giving way to) which is good
Any experiences or advice would be appreciated.

Most now have uninsured driver promises meaning non fault from the start, otherwise you are down to the MIB fund regarding it.
It could still impact future premiums mind.
By all means report it, but having been in a similar situation some years ago...with dashcam etc. The police still went lack of evidence which stunned me.

MIB will only pay out if there is no policy elsewhere. If you are fully comp they won't pay out. It could still impact future premiums mind.

OP just because it's not showing on MID doesn't mean it's not insured.

It doesn't matter whether your insurer has an uninsured driver promise or not - you cannot claim from the MIB if you have comprehensive cover. This is because the main purpose of the MIB is to make sure that victims of uninsured drivers are not left destitute if they are seriously injured and unable to work - not to make sure they keep their no claims bonuses. So it will only pay for losses which are not covered by any insurance policy at all - including your own.(Fortunately for the OP Direct Line do have an uninsured driver promise, so while that isn't a guarantee that there will be no effect on his premiums at all, it does mean that it shouldn't be too bad).
MID can be slow sometimes, once it didn't appear for 9 days.
I've also let some off in the past, they likely had insurance but didn't want to make a claim as damage was cheap for me to fix myself and feared insurance hike.
May be a bit more careful in choosing insurer when renewals come along.

Does that mean what I think it does?, if insurer can't claim the costs due to at fault driver being uninsured then you get it on database as at fault or recorded in a way insurers hike price?(Fortunately for the OP Direct Line do have an uninsured driver promise, so while that isn't a guarantee that there will be no effect on his premiums at all, it does mean that it shouldn't be too bad).

Asi understand it, "fault" is the wrong mindset.May be a bit more careful in choosing insurer when renewals come along.
An insurer will record a claim on your policy if they have to foot the bill. Irrespective of whether it was your "fault" or not.
With an uninsured driver, if you are fully comp, then MIB won't pay, leaving your insurer to meet the claim. Ie "fault" on your insurance record despite not being your "fault" in real life.
If some companies offer policies to side step this issue, then I agree it is a factor at renewal time.
However, my random price comparison quote went from £229 last year to over £600 this year. So another random price comparison site this year has come in at £289 instead.
Am I scrutinising "small print" ( I know it's the same size print etc) to see their terms on xyz contingency? Hell no. I'm doing what everyone else does, and enjoying the race to the bottom on headline price.
My cunning plan to just avoid having claims is largely working so far....

I had an uninsured van driver run into the side of my car on a roundabout a few years ago. I reported it to my insurer at the time, Admiral; I don't do accidents without reporting them (other party can claim all sorts of things, I want the protection).Had a car come up behind me at speed and fail to stop.

Admiral adjudged it to be a 50/50 and although I disagreed with this assessment, I paid the excess, took a minor (+10%) hit on the next years renewals (lower NCB, plus a claim). I opted to use their repairer rather than a main dealer. They did a good job replacing the door skin on my car (the hit was light enough that the glass in the door survived!). You can't really tell other than it has probably fewer minor issues than the rest of the car has.
About 2 years later Admiral emailed me to say the other driver was uninsured, they repaid me the excess I'd paid them, and made me whole for the NCD losses. I'd basically written the whole thing off as a bad deal but I need to give them credit for eventually resolving in my favour, albeit in this way.
Main advice I'd give is, look at your current insurance policy as it pertains to this stuff.
I was 15 days with Lancaster insurance before my car was on MID. 15 days of 2 hours on hold, ignored emails and frustration. It took me a fortnight of similar to get the car added to the policy in the first place. /rant
Just because it’s not on MID is not 100% guarantee it’s not insured.

Thanks for the replies.
I've logged the accident with direct line tonight and will wait for them to get back to me. They have already said that from my info it will be a no fault claim, along with having a witness it should all be fine.
Next step is going to see my GP as I've had a headache all day and neck/shoulders are stiff/sore too.
Hopefully it's all nice and straight forward.
I've checked the MOT and VED databases too and the car is taxed and was MOT'd on the 6th October. Quite funny that he's then written it off on the 7th (It was a MK4 golf that hit me). So at least with it having a MOT and being taxed, I think the chances of him having insurance look positive (VED renewal was September)
