Stopped on the M40 southbound, speed gun reading of 91 mph. Gave my details at the roadside, was sent an email saying:

Offence: Speeding - exceed 70mph motorway limit
Code: RR84019

You will be reported for consideration of the question of prosecuting you for the above offences.

Also that they’ll be in touch and if I haven’t heard in 14 days to contact them.

The officer said too fast for a speed awareness course, but suggested I was looking at 3 points and £100 fine. Looking online it seems that 91 is the boundary though, so any experience on here of what I should expect?

I’m not planning to fight it, I believe I was doing to speed quoted and don’t have mitigation other than the motorway was reasonably clear and free flowing.

First offence, if it makes a difference.

This tallies with my experience, albeit at a lower speed (and limit)

Yes, you're correct, you don't have any sort of mitigation; motorway conditions are no form of mitigation.

It's not a hanging offence, I think most of us have down 91 on a motorway.

Just so - having seen similar topics in the past, a few posters do tend to be “fight them all the way”, which is why I mention that I don’t have any mitigation. I also mention the conditions as I’ve seen others decry any form of speeding, so was hoping to avoid both types of reply. biggrin

The officer was polite, I know I was speeding, and having spotted them (too late!) on a roadside stopping point and checking my mirror to see them move off and turn their lights on I pulled to the inside lane and slowed below 70 for them to catch up with me. I was half hoping to just get a talking to or see them go past to somewhere else, but no such luck!

I don't think 91 is anywhere near any boundary it is likely dead-set on a 3-pointer & £100 up to 95 as above unless there are additional negative influences which I doubt as they would have said.

It will be 3 points and a £100 fine, they will not want any further / court agro for that speed.

Hope this is in line with the current state of play. Points and a fine I can do, having to attend court for a larger fine and lots of points / disqualification for a spell would be rather worse. Not least as I’m off on holiday for the start of October, and attending court then would be tricky!

For reference, this link is the one I found where the 91 mph boundary was mentioned.

More than happy if, as outlined above, it’s 95. Will update if / when I hear from them for future reference for others. smile

I think the link you have above is if the case ends up in court rather than getting a fixed penalty as it talks about fine categories. As the offence was on a motorway, courts can issue hefty fines.

I would take 3 points and a £100 if offered.

Not applicable to your case. That’s for people who are prosecuted.

91/70 is a fixed penalty. £100. 3 points.

Excellent, thanks. Well, relatively - I suppose I could not have been speeding, or not been caught!

And before you ask about declaring points to your insurer, you should check your policy documents.

And slow down smile

They will need to be declared, but not until renewal. Some insurers may say otherwise in their documentation but any request to declare them earlier is completely unenforceable. They should no longer be asking for earlier notification.

interestingly - didn't realise they pulled you over on the M40 for speeding, always thought it was just a letter through the post.

I've been doing close to 1000 miles a week on the M40, most of that at 85mph, except when waze flags up highway patrol or mobile checkpoints. Not seen anyone actively pulled over though.

TVP have quite a fleet of unmarked cars, including the 5-series estate which nabbed me for 91mph Northbound. I had the standard interview in the back of their car and got the resulting 3points / £100 fine. frown

As above and in other posts.

I've just been caught at 92 in a 70 and it was 3 points and £100.

I was slightly goaded into it by having an unmarked BMW up my chuff for a while and then I booted it. Still my fault though.

Happened to me on the M6 in Cumbria earlier this year - I was doing 86 when I went under the bridge with the camera van on it. frown

Took the FPN offered so 3 points and £100 fine. I declared it to my insurer at renewal and it didn't make any difference to the premium.

Yeh my car/bike insurance weren't bothered either.
