Am I Walking Into a Solicitor's Trap?
Discussion
Letter Before Claim received relating to a parking charge from a private company. The letter is addressed to me because I made a representation about the subject vehicle. I also made it clear that I was not the driver.
I called the solicitors firm today to state that the letter is addressed to me when I was not the driver. Also, the vehicle is registered to a company. They said to send proof of this (ie, a copy of the V5).
What could happen now? Would they then readdress the LBC to the company?

I would guess that they would then address the parking fine to the company. If you own that company and did park without paying and not in accordance then might as well pay the fine in my opinion.
I hate parking fines / charges when it is really hard to work out how to pay or if you should pay but if it is a fair cop guv then pay up and move on.

Don't send them anything V5 related.
I would as someone has said refute the claim as the RK not the driver, never admit who was driving, very important.
Most of these that I have seen will not file Letter Before Claim is purely a bully tactic in 99% cases, but very important you don't ignore and show you will not be bullied. The letters, endless debt companies and allege solicitors often a made up legal office within the PPC or Debt Agents estate.
The primary game with these in many cases is to get invoice charges paid, in what I would say is similar manor to TV Licencing.
I have yet to experience one file a claim after a robust, response to LBC.
I assume they got your name when you responded to charge notice and assumed your with the debtor?

presumably you made a representation (ie replied to previous correspondence) on behalf of the company to whom it was addressed? So they know the RK is a company? Who are they trying to claim from? You or the company?I called the solicitors firm today to state that the letter is addressed to me when I was not the driver. Also, the vehicle is registered to a company. It's addressed to me which is silly as I made it clear in that representation that I was writing on behalf of the company to reply to the charge. Last Tuesday I dug a pit in my garden, in front of a sign saying “conveyancing needed”, covered the hole with some branches and leaves and left a nice leather briefcase on top. So far I have trapped seven solicitors (a most felicitous number).
I feed them each morning, tossing in a Kellogg’s variety pack of those tiny boxes of breakfast cereal (Containing Rice Krispies, Coco pops, Cornflakes, and Frosties). They have set up a daily court and processes to determine who get’s the 8th box each day.
They are taking their confinement well, as well as a legally trained person could, though they say they will ‘see in court’ when I visit in the afternoon to collect the discarded cereal boxes and take their outgoing post. They think I am posting it (I gave them a stamp to frank it), but I am piling it up in my airing cupboard instead.
One solicitor has requested a legal secretary so i have put an advert up on gumtree.

How about ?
Many thanks for the invitation to name the driver. I am more than willing undertake such investigations, the price will be £500+VAT and disbursements. This charge is for me to carry out necessary enquirers into the driver and obtain their permission to share their private data with yourselves. It is not a guarantee that I will be able to find such details or obtain their permission to share data. Invoice included.
