Hello all, watching this afar in the Caribbean and just noticed this story from an old jounalist friend on Londons Evening Standard.

Analysis suggests that Magistrates spend on average 90 seconds considering Court Cases - how very dare they!

I always thought that this relativley new process from 2015 stinks and it seems I have been proven right as usual - a quick cash Tax grab.

It is not fair and equitable for most and does not have much to do with good old fashioned English Justice - Consequences - Punishment!

In the main all I ever seemed to have read about was as to how this MOJ 'tool' was used as a Blunt Instrument for this Governments Police to continue to wage the War on the Motorist (just another Stealth Tax) I think it was very handy through the Covid-19 Pandemic when Courts were closed.

I personally beleive it was something drempt up or cooked up by crafty Common Purpose Graduate Civil Servants within the Home Office aka the Liberal Lefty Woke Blob Snow Flake Millenials to enable some Magistrates Courts to be shut and thus save cash - in turn the Home Office Staff responsible for it raised profiles and filled in Linkedin with some easy wins - Speed Awareness Courses are just another Tax and huge money earner - no Justice at all.

Wondering as to what Andrew the PH resident and most excellent legal eagle AGT Law opines about the SJP re this exposure?

Pressure mounts for rethink on ‘fast track’ justice after more outcry over cases

Pressure grows to change controversial single justice procedure as Standard reveals more worrying cases

At least 4,000 prosecutions a week are brought through the secretive fast-track court system, where hearings are allowed to take place behind closed doors and magistrates spend as little as 90 seconds considering cases.

"Between 1 January 2022 and 5 October 2023, over 615,000 criminal cases were completed through the Single Justice Procedure"

The article is full of incorrect information and it is mixing up mitigation and facts.

The accused elects for the SJP, they don't have to if they don't want to they can have their day in court.

The reasaon it takes 90 seconds is because they have pled guilty. Stamp form move on.

The only real issue is it is not open to the public to see that a CTTJ is present at all times.

Single Justice Procedure ...
I've helped many defendants avoid disqualifications by taking advantage of the Single Justice Procedure. It largely benefits those charged with minor motoring offences. It saves them time and money, and provides two opportunities to avoid a ban, whereas previously there was only one.

I think the biggest issue with the SJP is the use in other areas of law, such as DVLA and TV licensing.

SJP - nobody has called out the fact that as I stated and called it a Speedily Judged PRECEPT - a clue in the name then - a Stealth Tax !

It is not fair and equitable for most and does not have much to do with good old fashioned English Justice - Consequences - Punishment !

Clearly along with Speedy Cam Courses - amongst all the other Courses that a Motorist can be hit with for moving traffic violations (in the pocket) which are just a cash carve up divised by the HMG - Home Office - Police and Private Companies like the AA - TTC - how long until the UK MOJ wants to give on-line Courses for Fraud - Domestic Violence - Burglary - Mugging - Stabbing - because the Courts and Prisons are old and closing down or full !

I was talking to an English Judge from London whilst doing some Scuba Diving on a Dive Boat out hereat Xmas and he told me that he 'Sits' only a few days a week and that ALL the Judges should be Sitting 7 days a week to clear all the back log - I suppose due to Covid and Court closures !

Please advise me as to where Ye Olde British Justice actually is - THE only person who gets dealt Punishment (well Fined) is THE Motorist - read any UK newspaper or UK on-line MSM and often all you will read is repeat and or serious offenders seemingly getting away scot free !

Precept - BRITISH

An order issued by one local authority to another specifying the rate of tax to be charged on its behalf.

"the precept required a supplementary rate of 6.1p in the pound"
a rate or tax set by a precept.

Any thoughts on the above then - and also why is Katie Price STILL driving unlike any other PLEB nicked in the UK by the Cops ?

Your rant is completely irrelevant.

As you have already been told nobody has to elect to go down the SJP route, it is reserved for those that have ALREADY pleaded guilty.

If 'stealth taxes' are so bloody stealthy then why do I hear about them so much? Quite often, it has to be said, as one ingredient in a semi-coherent word salad.

Electric BMW - my Rant is completely relevant - I am on the Money - re the Money - the below is NOT a Rant but true facts !

Point me to ANY Justice (or for the benefit of the Public interest or Public good or Public purse Prosecuting this chap in the best interests of Society - it is a stretch I grant you sir) for the 83 year old gentleman who got Nicked and done via a SJP for having gotten Dementia and forgetting about his old MG and now living in a Care Home as his car Insurance lapsed - his Daughters Mitigation to the DVLA did NOT get a Butchers Hook = Look !

As I previously stated I do NOT beleive that SJP are an effective piece of Justice - Consequences or Punishment and I would suggest that most motorists think the same - back in the UK it is ALL just another Stealth Tax - along with the Speed Cam Courses and Private Parking Ticket Scams - along with Con Charge - CAZ - ULEZ - I just read about the M1 in Sheffield with a speed limit for Air Quality (why did Teslas etc get Nicked then as they are clean Battery powered EV with no tail pipe emmissions - or is it because of the Tyre and Brake Pad Emmissions now) and NOT safety and raked in MILLIONS in Fines - like Sheep - Lambs to the Slaughter House - a dead cert !

Out here in BIM - the Tropics of the West Indies - Drink Driving was not even against the Law and locals often used to drink bottles of Banks whilst driving - you could get Nicked for driving without due care and attention though - Brethalysers were only rolled out to Cops after Covid-19 was announced at the end of March 2020 and the main thing here on this little Island with really crappy roads is crazy speeding (often by Buses or Public Transport) motorbikes - no seat belts - mobile phone - drugs and little Police about with little appetite or aptitude for enforcing traffic violations !

Under the 2020 amendments to the Road Traffic Act being in violation of the prescribed blood alcohol limit, which has been set at 35 micrograms of alcohol per 100 ml of blood (0.08), will result in a fine of $5 000 or imprisonment for a term of two years, or both in the case of a first conviction. In the case of a second conviction, a fine of $10 000 or imprisonment for a term of five years, or both will be imposed.

A person can be disqualified from holding a driver’s license for a period of 12 months up to 5 years if convicted.

Not quite. A single magistrate looked at it. The single
magistrate could have referred the case to a traditional court hearing but, unfortunately, didn’t.
