What do we think? Friend says her daughter was fined 6 points for using her phone to pay for a McDonald’s drive through.
Apparently she was in the drive through with a police car behind. She paid using her phone and was then charged.with using a phone in the car while driving.

Someone is telling a fib, or it’s the most easily appealed six points ever.

You are specifically allowed to use a phone to make a contactless payment at a drive through.

Exceptions
You can use a device held in your hand if:

you need to call 999 or 112 in an emergency and it’s unsafe or impractical to stop
you’re safely parked
you’re making a contactless payment in a vehicle that is not moving, for example at a drive-through restaurant
you’re using the device to park your vehicle remotely

She’s lying. She’s been caught on the road and now she’s saying it was while making a payment. Which is bks.

The amount of young women I see texting and driving on the motorway in heavy/slow traffic is really startling.

The actual wording of the exemption is here - see section 5B

https://www.legislation.gov.uk/uksi/2022/81/regula...

Unless she was fiddling with her phone while the car was moving slowly (in which case it would be harsh but technically correct). the police have got this one wrong. She should decline the fixed penalty and send a letter pointing out that her use of the phone was covered by a specific exemption, which will hopefully ensure that she doesn't end up having to go to court once it's read by someone with a clue.

This assumes that her story is accurate if course - young people who are in trouble with the law don't always tell their parents the whole truth about what they did so it's always possible that she was doing more than just making a contactless payment.

Sounds to me like caught on the road but telling parents it was at a drive through so they don’t kill her

Next she’ll be saying the cop was PC Mac, she was stopped on a Sundae, grilled for the alleged offence, she was searched for coke but she took it all with a pinch of salt. 🤣

I'd wager that there is another side to the story, most likely the actual truthful one.

It's doesn't really matter who shot who, from which balcony however.

All that matters is friends daughter was spotted dicking around on her phone and now has 6 points.

Good result, let's hope she leaves the fking thing in her bag\pocket from now on!
