In November 2012 my son-in-law was issued with 6 points for speeding on the M6 toll (96mph) he had at that time an expired endorsement for 3 points recorded on his licence dating back to 2006 but as he had not changed his address had not sent his licence in to have these removed. On getting his licence back from the court with his new endorsement handwritten he decided to send it in to the DVLA with the fee of £20.00 to have his expired points removed and his new ones printed.

Forward to this week and he gets his paperwork back but to his surprise his new endorsement has not been added to his licence now he is obviously quite happy about this as he says its whoever was inputting the data at the time that made the mistake and is adamant that if the information was entered correctly his licence would of come back with the proper endorsement, so as far as he is concerned he has a clean licence.

I've suggested that he should contact them with a request for his personal details, I think it's about £5.00 for this service but he's just not interested despite myself and my daughter expressing our concerns and taking a legal/moral stand with regard to his insurance etc.

My question is if the DVLA failed to print the endorsement and as such has no information on their system is he in the right?

If the court says he has those points then he has them regardless of what DVLA has or has not done to his licence

Does the DVLA database say clean or just the licence??

Maybe the licence was printed before the update to the computer.

He needs to be very careful with his insurance.........think it through.

In theory the DVLA database that we access will still show the points, they just weren't printed on his licence. But with the DVLA, you never know!

If he had got the licence back with more 'live' points on it than it should have would he have done anything about it?

It will be in the Court records. Highly likely that DVLA had not been updated before sending out his new licence.
He knows he has the points and for how long they remain in force.
In respect of applying for car insurance you might want to show him the penalties for Fraud (Fraud Act 2006 Sections 2 or 3) which includes up to 10 years imprisonment and/or an unlimited fine.
Plus the possibility that if caught he may find it difficult to obtain insurance in the future at ANY price.
Not to mention the effects of a dishonesty conviction on his employment prospects.

Roughly translated: I can't be bothered spend the time to write coherently or check my spelling, but am still asking for you to spend your time in helping me with a potentially complex situation.

All this on a 5 year old thread wow,

Nutter, you need to go back to your insurers with written evidence I.e. a letter confirming what you say is true. They should accept this and reverse the situation (they work on the principle that you should be left in the same position post loss so I can’t see this as being any different). If they reverse/withdraw it it will no longer be in your record.

But... and seriously with spelling as bad as yours please get someone else to write it for you as it will not help your cause. Bad English will affect you for all your life unless you decide to get some help. There’s no shame in asking for help, you recognise you have a problem a few hours at a night school will help I’m sure.

For the love of god it’s yet another attention-seeking troll. They deliberately post stuff that will get vitriolic responses and they deliberately use spelling and grammar which will attract vitriolic responses.
