i recieved this letter through the post at the start of the week (27th oct)

theres no actual place mentioned where ive been "speeding"
in the location mentioned it is a seaside village, pretty much a straight road of a village, all 30mph, nothing less.
there are also no fixed speed cameras, and nothing that i recall was parked clearly upon the side of the road.

now, ive been told a few things, mainly that i need to ask for photo evidence to clarify if it was me in my vehicle, and that i should also be asking for a calibration sheet from the day i was supposedly caught speeding.
other people have mentioned that i shouldnt sign anything yet as this may show that i am taking responsibility for the ticket while others have said that the ticket should have been issued within 14days of the offence?

whats best advice to take?

My first advice is that you take a course on mobile phone photography and posting photos on the internet!

As for the speeding, did you speed? If so, why not just take the course or pay the £100? Think of all the other times that you have got away and will get away with speeding.

There are few magic get outs. Presumably before receiving what looks like a conditional offer of a penalty you first received a notice asking you to identify the driver and did so. That notice should have been sent within 14 days of the offence.

As for location, what do you want them to say? Middle of Borth, edge of Borth? Next to Fred's mum's house? You have been given the location.

Don't forget to state that you deny being "Chris Vance", and are to be referred to as "Chris of the family Vance", and since all law is just a contract which you haven't signed, you can't possibly be held liable.

After all, a conviction for failing to identify the driver is infinitely preferable to half a day of drinking tea.

ok, firstly let me apologise for not owning a topspec SLR to take photos of a piece of paper, the photo i have provided with my galaxy s2 is sufficient enough to show the information,
maybe i should post in the photography forum?
i know this username isnt a top poster but i regularly browse the forums and i cant access my previous account? anyway...

i have no problem with taking the hit, i recieved points previously and the forms have been more detailed than this one, (ie the B345643)the speedlimit i broke aswell as the speed i was travelling,
this letter only shows it was a 30mph limit, but dosent show what speed i was doing, hence the confusion as i generally drive sensibly due to driving for a living and cant risk my licence etc.
i havnt recieved anything regarding the driver, so maybe ill send a correspondence letter regarding that matter first.

thanks for the input.

i am not looking to deny anything, but i find it odd that there are not more details in the letter and the fact its been almost two months?

do i send a letter in asking for camera picture to identify driver, aswell as a calibration sheet.
id like to know what speed i was doing too, as mentioned in my previous post, a previous conviction stated the speed i was travelling at?

im not looking to avoid, or deny the charge if its right, just clarity.
but id like to know how to go about asking correctly.

My money is you being pinged along the seawall section near the golf club. It's arrow straight and there is a speed camera warning sign on the same post as the 30 limit. Perfect place to trap people who don't slow sufficiently coming from Ynyslas (or give it beans too soon going north).

The image that the OP has posted appears to be a conditional offer of fixed penalty not a s172 request so a conviction for failing to identify the driver would seem unlikely.

OP - are you the RK of the vehicle that was alleged to have been speeding? If so you should have received a NIP within 14 days of the offence. If someone else is the RK they should have received a NIP in the same timescale. Did this happen?

The photo you posted is a COFP which suggests that a 172 request has already been returned naming you as the driver - has it and if so who sent it?

You can request photos to assist with identifying the driver if you're not sure who was driving. They are under no obligation to provide these but usually will do it to assist. If you knew who was driving, don't request them

They're under no obligation to provide this evidence or any other evidence unless you plead not guilty and go to court. I'd only recommend doing this if you can prove you weren't speeding

Is it a NIP requesting the drivers details of who was driving the vehicle at the time of the alleged offence?
If so, they're usually served within 14 days. Is the car registered to you, were you driving it and do the V5 for the vehicle and your driving license address all match with your current address?

If you were the one driving and it's a request to name the driver, then normally it's best to send back the NIP (if that's what it is) naming yourself with your details.
If you refuse to sign it then you may be summoned to court for failing to provide driver details. That carries 6 points and a higher fine.

more than likely yes up by the golf club, my friend lives in ynyslas so i was more than likely on the way to/from there and i know its all a 30, so id know to slow down there, its not like im a stranger to the place :/

i think if i have been speeding, its more than likely a small margin, probably as i am approaching borth.
either way that isnt important.

thanks for the advice, i shall get the letter away tomorrow.

Is it a request for drivers details (NIP)?

Are the address details on your license and V5 correct and up to date?
If all the above is yes, then the NIP should be served within 14 days if i remember correctly. If it's served outside this period you may have a get out clause.

Just about any image software has the 'rotate' function. 90 degrees left and you get this:

Better than standing on ones head etc.

Ahh it says on the letter "We have confirmation you were the driver" meaning the original NIP was sent to someone else and they have named you as driving at the time / place.

The NIP must be served to the registered keeper within 14 days but it may take much longer for it to reach the driver, as it has done in this instance.

sorry about the picture quality, i spend most of my time lying on my side wink

in regards to registered keeper, yes, i am registered keeper, although this is the first piece of correspondence regarding the matter,

just makes me wonder if maybe there was a digit wrong in the reg? could be multiple reasons.

ill get in touch with them, and update the thread as and when,

thanks all for your time and advice

If you are the RK and your V5C record is a match to your current address, and you weren't stopped at the time, then the BiB/SCP/whoever don't have a clue who was driving. Therefore they must serve a NoIP/S.172 request within 14 days of the alleged offence as only the driver can be given a CoFP for excess speed.

So what evidence do they have that you were driving and how did they obtain it (if you didn't give it to them)?
