Have a read through this:
http://www.cps.gov.uk/legal/s_to_u/sentencing_manu...
See if any of the 'aggravating factors' or the cases quoted apply to your circumstances.
As the penalty includes imprisonment of up to 2 years I really do suggest you consult a solicitor who specialises in motoring matters.

I've come across 2 people who have been done for this, and both fled the police and got caught after a chase.
I don't know if it's reserved for that, but it's a pretty serious deal.

If you consult a solicitor you will get the professional help needed for such a serious offence.
If your solicitor mounts a robust defence, then offers the CPS the option of 'going all the way' with the DD prosecution to which you'll be pleading 'Not Guilty', or reducing it to 'Driving Without Due Care & Attention' to which a guilty plead will be entered, the CPS may take the 'soft option'.
It depends on how strong the DD evidence is. If it could be a matter of opinion and there was no accident or damage, that might work. If there exists real and serious evidence of DD it may well not work.

Wouldn't it be more efficient to merge all the threads the OP has made on this topic?

I did, in 1999, for doing 105mph on the M74. It was in Scotland so the law is a little different.
Get a good solicitor. I did and ultimately kept my licence and ended up on reduced charge of driving without due care.

I did back in about 1989. 102 in a 50 on the motorway just as the signs started. Dry day and road clear. £250 fine and a months ban.

OP's other thread said that an NIP was not required, which leads me to believe there was a collision involved.

I'd suggest a chat with Andrew at AGT law. I think his user name on here is agtlaw.

I know someone who has had two of these, resulting in bans with extended re-tests. By all means PM me and I'll put you in touch with him - he's a fellow petrolhead.

From the PH posting rules-

"Do not choose a username which is the same as a company or trading name, nor create multiple profiles or attempt to use any other person's PH log-in to post content without permission or promote charity events, recruit for charitable donations, surveys or seek votes for competitions without permission nor promote events without permission."

For Dangerous Driving?

I knew someone who was convicted a few years back. A damage only accident lead to a £400 fine, a years ban and an extended retest. Oh and a criminal record.

come to think of it, it could have been called reckless driving. all a blur now, I felt the charge was over the top.

It appears to me that there are occasions, where no one is hurt or if there has been no collision that people admit to careless to avoid more severe punishment.

I am however no expert.

A mate got a bit silly with two cyclists who just happened to be coppers. I honestly don't know of he dd it, and I do think the coppers behaved badly in court (outside the court room) but that's by the by.

My mate admitted to careless and got a big fine and a 6 month ban. Judge warned him that had he been convicted of dangerous the punishment would have involved a loss of liberty.

Last year in Scotland I reported a scary bit of driving. The cops got the guy and he was charged with dangerous. The day before trial he admitted to dangerous and from memory got a pretty big fine and something like a 2 or 3 year ban.

Lots of better qualified folks on here but from chatting to my mates solicitor in the pub afterwards, he suggested its cheaper and better for everyone for the CPS to get an easy win for something lesser.

My mate was very probably a bit of a dick with those two cops. He avoided jail, but the fine hit him hard and the ban made it impossible for him to run his business (It involved a trailer and the friend who was going to help was not qualified to drive it but by then the case was over) which he sold.

Get a solicitor asap. You are facing a mandatory ban if convicted so whether challenging the offence, or looking to reduce the sentence, a good solicitor will make a difference.

If speed related, COPFS in Scotland, and presumably CPS in England and Wales, can reduce the speed by 10% at any time during proceedings. Bear in mind S.3 can often cover up to 110/115, that's 120/125 mph before haggling. That can bring a 12 month ban down to 30 days or less.

Yes. I got £1000 fine, 20 month ban for Dangerous driving. The crime. Driving 138mph on the M74 in clear dry and quiet conditions. Lawyer did well to spare me the back ground reports and possible jail process.

I'm now preparing to take my extended test. Its not fun.

should do a freedom of information request to find out how many times the police have done similar speeds on that road or a similar road, and how many of them were charged with dangerous driving.

What's that going to prove? Seriously, it's not much of a defence to say "I committed a crime, but so (possibly) did some others and they weren't prosecuted for it."

I've never understood why for offences like this, they get you to take a test again? I can understand them putting you on a speed awareness course but taking a test again, that's not achieving anything- you can already drive? You know you've been a naughty boy.
