Just looking for a bit of advice from the PH massive who maybe have had previous experience or know a lot more about the laws than me!

Basically i got stung with a parking ticket last week by a private parking company for parking in the car park outside my flat, in Leeds, which i have a permit for. The reason for giving the ticket was that my permit was not on show which admittedly it wasn't it was in my glovebox where it has been since September. Having read previously on parking ticket threads the main advice was to file in the bin and forget all about it, but am i right in thinking the laws have been changed to make doing that harder or less likely to work?

I sent an email to their appeal e-mail address basically stating that i have a permit for the car park i got a ticket for parking in, and attached a picture of the permit. I have yet to receive an e-mail back however i am not getting my hopes up that they will reply with "oh terribly sorry chap, if you have a permit that's fair enough don't worry about the ticket" Just wondering if i should drop trou and bend over or whether i can combat this? as i feel i have done nothing wrong apart from not display my permit.

There are currently three or four threads running on this exact subject. Mods, could we not merge them all into one?

You may hear nothing further, but, if you do, write a polite letter pointing out that the charge is unenforceable as a penalty and that in any event your parking caused no loss to any party.

The law has only changed recently in one small and in your case irrelevant respect. It remains the case that the party that has issued the ticket (which is in fact a bill) has to prove a legal entitlement to the money claimed, and here it probably cannot do so.

PS: someone else will be along in a minute. He will tell you to spend hours of your life hanging out on some websites run by some deeply sad people obsessed with parking tickets, and to copy lots of verbose and ranty letters that they draft. You can do that if you like. Or, not.

You could ask the car park owners to discontinue the car park patrols in which case you'd probably not be able to park there as it would be full of cars without permits.

Alternatively you could ask the owners to agree with the parking company an admin. fee for people in your situation and you could offer this sum to the parking company, e.g. £20. Afterall they spend time and money patrolling the car park for your benefit.

My apologies, feel free to merge this thread!

Thanks for the advice Breadvan72, i was of the impression that the law change had wider implications. When/if they do eventually reply i shall use the advice.

The parking obsessives make out that there was a sea change in 2012. The only sea change was that clamping and towing on private land was outlawed. The other change, actually quite minor, was that now in some cases a claim can be made against the keeper of the car even if he /she did not park it. There still has to be a valid claim against the driver in the first place.

The parking companies set up a non statutory and optional appeals panel called POPLA, which the obsessives spaff their kecks over, but that has nothing do with any change in the law.

Right i see. So in reality there has not really been much of a change, and they still have to prove they have a legal entitlement.

Breadvan...with all due respect, please can you stop looking at these threads. They obviously annoy you, and slating the helpful people on MSE and Pepipoo is getting boring now. The difference between you, and the people on the other sites is that they actually give helpful advice and tell you exactly what to do. I have followed their advice in a similar situation - parking ticket because the attendant didn't actually see my permit that was on the dashboard...and I won at POPLA no problems. Many other have also successfully claimed.
If you want to be genuinely helpful, you could tell us in detail what to do like the other guys. You could be our very own expert??

OP - everything you need to know is here: http://www.moneysavingexpert.com/reclaim/private-p...

Someone else will be along in a minute to say you didn't display your permit, you broke the rules, the hard pressed private parking company has had to put a huge amount of resources in getting in touch with you to point out to you that you broke the rules
Now it is right and fair for you to pay for their admin, which is pure coincidence that it happens to be the same amount as a parking fine.

The reality is that of course the parking company do have to put in a significant amount of work, and in this case would have had to visit the car pak personally. After all if it was done by CCTV they'd know the OP has a permit.

Equally in this case it is the OP who benefits from the parking enforcement as if parking wasn't enforced he would not be able to park due to unauthorised cars in all the spaces.

The reality is that there has to be anforcement of parking rules in private car parks so that those who are entitled to park there can do so. The cost of that enforcement, together with an element of profit has to be paid by someone, and why shouldn't it be paid by those who cannot obey the rules? Why should the OP have to pay the cost of enforcement action to stop people parking in his parking space? Of course the downside is he has to pay when he breaks the rules.

What I do know from my time in property management is that parking and heating are the biggest cause of complaints.

You can't even rule the Tri State Area, Dr Doof, so you don't rule me. I decide what I read. Anyway, why not read what I say? I make a clear and simple suggestion of how to respond to these claims. I am trying to save the OP the hassle of getting embroiled in all the over complicated blah advocated on those wingnut websites.

OK.

Anyway - OP. Check the MSE link I posted above which lays out the very simple process you need to follow.

You could pay £16 and have the bulk of the work done for you:
