Parking Eye Charge - gone away?
Discussion
Chaps,
I got a penalty invoice from Parking Eye for exceeding the time limit of my ticket when I rode my bike on Snowdon back in October.
Due to a combination of travel and the Mrs sticking my post in a drawer I only caught up with it once they were threatening me with court.
The 'fine' for overstaying my ticket by an hour was, by this stage £150.
I used one of the standard response letters as an appeal to the fine and sent this off several weeks ago - I have heard nothing since and assumed that they had just dropped it.
However today I have had the appeal letter sent back to me due to incorrect postage (apparently a 1st class stamp doesn't allow you to send 2 bits of A4 any longer) this is about a month after I sent it off.
Given that I have heard nothing more from Parking Eye should I just carry on and let sleeping dogs lie - or am I actually risking a CCJ on this?
Thanks

Would I get a summons to from the court if they did go that route?
Yes - well, sealed court papers rather than a summons - from Northampton.Mr Gearchange said:
Is it even remotely likely that they would do that?
For this company, pretty likely indeed (they are currently very litigious).Mr Gearchange said:
Trying to claim back £150 for overstaying my ticket by an hour?
plus costs of the hearing etc (from memory).Mr Gearchange said:
I'm a bit nervous as I'm currently going through a mortgage application..
Well, you'd better put a proper 'hard' defence in when the sealed court papers arrive
! Joking apart, moneysavingexpert, pepipoo and (especially) 'parking prankster' websites will see you through this without a blemish but with a bit of your time needed
. PE are not one of the PPCs to 'ignore'. You could always attempt to name the driver at this stage, which resets the clock and will allow to appeal to POPLA and knock this on the head (but they may not want to play this game).Thing is, they've put the willies up you (which is what they want, in that it will make you consider paying the exorbitant amount they are claiming
) - they are bad-breathed bullies with no bo
ocks and a proper defence submited to the small claims court will see them withdraw at the last minute (should it get that far
).^^This^^
What you will get is a money claim issued in the Northampton County Court - see post #27.
It's your call whether to ignore. Personally I would simply resubmit the appeal asking for a POPLA code should they reject your representations. They may give you some nonsense about them being out of time. That is pure BS. The PPC must accept or reject your appeal. If they reject they must issue a POPLA code.

A county court judge isn't likely to be too impressed if the PPC refused to allow the case to be assessed by the body set up for the purpose.

It won't be a summons. That is a document which compels you to attend to answer a charge or as a witness. What you will get is a money claim issued in the Northampton County Court - see post #27.

I note you mentioned Snowdon in your previous post. This tells you all you need to know about the type of company pursuing you. http://www.dailypost.co.uk/news/north-wales-news/i...Mr Gearchange said:

It would only affect your mortgage if you had a CCJ recorded against you. All you have at the moment is the usual threatograms. You also mention a standard response letter you sent. I hope it was suitably worded as getting that wrong won't help. I assume your appeal was in response to a NtK from PE: if so, did you check to see if it was fully PoFA compliant? It's your call whether to ignore.
