Hi

Just after a general guide, I am currently going taking somebody to court and we have been informed that the high court has moved it to the royal court of justice. is this good or bad, the defence have tried to object where my team has said it is good,

its a rather large case and this is the first time ever ive taking action against someone

Mods if this requires a different forum please move

No-one can advise without a handle on what your case involves. No-one will be able to do that as well as you own team.

What made me say 'woah' was if you are moving a case to the RCoJ, it's your first case, and you don't entirely trust your legal team to give you the advice that you've come to this forum to try to get, then that brings all kind of side issues.

The main one is though apart from sweeping generalisations which may or may not be correct for your case, no-one will be able to input much more without more information. Has it ben moved because the claim is for a high value?

Got your PM - I see where you are coming from.

It's very difficult to get inside the mind of your team though. It's clearly a big case financially or one which argues an important or contested point.

This is a sweeping generalisation, and may very well be wrong, but, your team may be thinking that the defendant's actions suggest that they are more likely to want to settle. However, though, I am guessing what someone else is guessing that someone else may, or may not be thinking - so you must take that with a 'pinch of salt'!

As long as you are not picking up the legal costs, even if you lose then you can let them crack on...!

thanks, theres lots of issues within the case and we have been granted insurance etc, The defence admits it but then denies it the next paragraph, they had 12 months then an extension to submit there defence and still left it to the last minute after applying to court for another extension which was refused by my team and the court

There is some guidance on transfer in the Civil Procedure Rules. See here:
