Hi,

I live with my parents, inclusive of my partner.

She has recently lost her job, and has therefore gone onto JSA. However she got a letter the other day stating that "you are not entitled to JSA due to class 1 national insurance contributions."

Now basically i understand that as she hasnt paid enough NI. Shes 21, and has been working full time since leaving further education. They have used tax year 2012-2013 to make this decision, now up until Sept in that year she was still at college doing her level 3 childcare, so she wouldnt have paid alot of tax year due to being only employed full time from Sept on-wards, although she was working part time at a local retailer (minimum hours.) tax year 2014-2015 she was on a full time wage paying NI.

She also pays my mother rent each month, is it possible to get some sort of contract between the two so she can receive housing benefit?

Cheers Guys
Chris

doubtful tbh:

When living with family members

You are not entitled to make a housing benefit claim if you pay rent to a close family member who shares all or part of the home with you. For example, if you make a contribution to household costs when living in your parent's home.

These people count as close family members:

parent or step-parent, father-in-law or mother-in-law
child or step-child
daughter-in-law, son-in-law
sister or sister-in-law, brother or brother-in-law
half sisters and half brothers

Partners of any of the above are also considered close family members.

That's Housing Benefit, the OP talks about JSA. Isn't your OH entitled to income based JSA if she's not entitled to the contribution based one, or is the household income/savings level too high for that?

Im not sure about the household income level, i earn a fair whack but my mum and her partner dont.

I just think its really unfair the amount of people abusing the system and when someone genuinely needs help its not offered.

If you earn a fair whack does she genuinely need help?

I assume that the reason she is living with your parents is so that the two of you can live together?

If you earn a fair whack then you don't need help.

When I got made redundant I was 45, with 2 kids and a 160k mortgage. My parter worked part time for minimum wage.

Our monthly outgoings to just survive were 2k. All I could claim was JSA. We simply had to live on credit until I could find work.

Thats a situation where you need support, and none is available. Nice when you've paid in for 30years!

My OH was told to sod off when she applied for JSA, the reason being they told her to mooch off me as I had considerable savings and owned my own property, so said she could live in free of charge.

To say I was not impressed with them was an understatement.

Thankfully it only lasted 2 months.

EFA spin (sos bit cruel)

Dave's spin on unemployment will be fun.
Some people now have to sign on daily at different times to disrupt their routine ie if are working.
OH was saying 3 have stopped claiming on the last week,

Not claiming doesn't mean in employment smile

Being blunt, you say you earn a fair whack, and does your Mum really need to charge her rent while she's out of work?

Unfortunately it’s worse than that, and one of my favourite soapboxes so you are warned. Before I married SWMBO she was entitled to, and claiming, incapacity benefit & Housing benefit. When we married and moved in together she was then told that she could no longer claim either of these as I earned more than £17,500. She was unable to claim JSA as she is unable to actively seek work, if she works she ends up in hospital within a month, so basically the state said “sod off and live off your husband”! She could have gone back to the Dr and got him to declare her “disabled” but she didn’t believe that she really was and didn’t want to milk the disabled system. We have since enquired a couple of times about what she might be entitled to but been told the same things. About 4 years ago we bought our own house and I weekly(ish) commute to a rented house near my work. She went into the CSA to ask if there was any state help available and was told that what she needed to do was declare us separated and then she could claim housing benefit and income support. As I was genuinely living away most of the time even if they bothered to check it would show up that I was not there so we would be ok. So the advice was to lie to the Government to get some help. Needless to say we didn’t follow that advice and she, effectively, still lives off me.

Now we are married and I don’t have a problem with that but it doesn’t help anyone’s self worth when the system says you are not worth helping as you married someone who actually earns and contributes!

As i said my mums and partner are lowish income. There has been a monumental cock up with her mortgage and endowment and it matures after its due (or something like that) so she now has to find a few pennies.

Am I the only one who doesn't regard supporting your OH as them "mooching off you"?

So let me see if I have this right the OP lives with his parents and his girlfriend also lives with them. From his own admission he earns a good whack. Yet feels his girlfriend is entitled to housing benefit?
And thinks it is not abusing the system.

If you earn a whack and your parents don't then you should pay them more for your and your girlfriends upkeep.

I must be the only one that thinks its wrong that JSA is seen as OH joint item when it should be on an individual basis, just cause I have savings, shouldn't mean they think its our savings, OH is her own person and she should have been treated like that... Married I would have understood, but this was early in our relationship.

I completely agree.

Not quite, but i wont delve into that judging by the attitude of others.

You will have to excuse me chaps. I have never been out of work, never had to use the government system so i'm unsure on how it works. I didnt know if she could claim housing or not, if she cant then she cant, im not saying im going to falsify a claim. Forgive me for being curious, cretins.

So in everything, do to others what you would have them do to you, for this sums up the Law and the Prophets.
