Setting aside, Claim struck out & Counterclaim fee refund.

I have looked everywhere and cant find an answer to this and the people at the court contact centre dont have a clue and they just told me to write in. Its been 2 months and I have heard nothing.

1. Woman issued claim against me and delibrately gives court a wrong address (incorrect door number) so I never got the claim sent by court.

2. Claim returned from wrong address.

3. Court informs Woman so she supplies correct address but elects to re-serve claim by hand. This never happens.

4. Judgement entered against me and sent to me at correct address.

5. I immediately apply to set aside.

6. Court ask me to file a defence

7. I file defence and make a counterclaim

8. Counterclaim fee cashed by court but no correspondence regarding counterclaim.

9. I attend hearing and judge sets judgement aside. Claimant doesnt turn up.

10. Judge says claim lacking in substance so will write to claimant to re-submit to court within 2 weeks with full details.

11. If claimant doesnt respond case will be struck out.

12. I ask judge about my counterclaim and she informs me this cant be dealt with until original claim is more detailed.

13. Judge said if original claim is struck out, there is no counterclaim therefor I will get a refund of fees paid.

I havent havent heard from the court about the original claim being struck out (over 4 months) and they havent replied to my letter from 2 months ago about getting the counterclaim fee refunded. I know for certian the woman didnt re-submit a detailed claim.(she is in Harmondsworth awaiting removal).

I would like confirmatiin from court that original claim has been struck out and also a refund of my counterclaim fee.

How do I proceed?

Alas, you're unlikely to get anywhere fast with the CCMCC's staff of semi-trained chimps, in my experience.

Put it into writing and the matter should be referred to a District Judge for review.
