Penalty charge notice time limits - Scotland
Discussion
My son has received a PCN/Speculative Invoice for allegedly parking his car in a private car park without paying. One problem is that he received it yesterday and the alleged infraction took place in September!
Now, if I were asked who was driving my car on a particular day 5 months ago I wouldn't have a clue. Neither does he.
Seems like a long delay in issuing the notice. Can they do this?
I know the normal responses to PCN - file in bin, etc!

These have no standing in Scotland so can be safely filed to the bin. Any subsequent ones can also be binned, there is no need to contact the sender.
I have had them and after 4 to 5 letters they gave up. Do not give in and pay. Recently (can't remember what website) police Scotland were also advising to ignore or, if you must, tell them you have no idea who was driving as they have no powers in Scotland to get you to identify the driver.
Recent court cases in Forfar and Dundee were dropped minutes before court was called. This says it all.
Good luck, Martin

Chorley services on the M6? In England? That wasn't very wise of you, the law has changed in England, the advice for a few years now has been to not throw them in the bin as they can pursue the owner of the vehicle nowOkay friend had a few letters in demanding payment - got one in recently saying that they are passing to another team who will be taking friend to court.... could damage credit rating could do this could do that and wanting £130. they have not replied but the letters still come.
Has the law changed on Scotland or is it still the ignore and don't answer etc. or should he give an answer or wait until they take em to court....

Ignore everything except court papers but in Scotland the chance of that happening is probably nill. The law in Scotland is the same as it's always been so safe keep ignoring and make no contact with themHas the law changed on Scotland or is it still the ignore and don't answer etc. or should he give an answer or wait until they take em to court....

How can an English court pursue him if he lives in Scotland?Neonblau said:

I've been getting approx 2 a week now for the last year and before that i got one every few weeks from the same company. Nothing ever came of it.
Do you get all those letters because you can't you read or are ignorant/selfish and feel parking on other peoples private property when you want how you want is ok.ruggedscotty said:
I take it that you are grieved with parking somehow ?
No i just see a a fair few ranty letters and a range of limp excuses from people complaining they shouldn't be 'charged' for overstaying in car parks
I wonder if network rail see the same sort of letters from people who go on the train without tickets or buy a Manchester to Birmingham ticket and complain if they get charged extra because they stayed on to London?

I get them because someone who drives a car registered in my name keeps parking it in a car park outside some shops for too long.ruggedscotty said:
Still train ticket avoidance does have some legal standing - threatening letters and such is harassment.
When they changed the law in 2012 maybe they didn't think it through properly ?Populist politics ?
Maybe train ticketing 'law'/train car parking law etc should change ?
If you Park at a station car park and don't pay or park incorrectly enforceable byelaws are in place, why shouldn't the same laws apply to the supermarket next door ?
Station car parks are ran by private co's maybe on behalf on network rail, not much difference except bad law?

Hopefully this PPC will be given its marching orders

Persisting in its attempts to pursue people in order to extort from them when it has no grounds to do so exposes the true face of this parasitic industry. Parking control my a**e.

Bluff and bluster in Scotland. Of course if the tactic works (see second link above) and recipients are taken in by the words could/may then there is every incentive for PPCs to continue. Cut the paper into squares and hang them in the smallest room. Free emergency toilet paper.ruggedscotty said:

No: it hasn't changed.Yes: ignore.
Yes: wait - it is unlikely to happen because the PPC can only pursue to driver not the RK and it has no way of knowing who the driver is.
Unless you're daft enough to tell them of course.
