Bit of an odd one, my friends girlfriend who is pregnant was a passenger in a car that was hit up the arse last week, nothing major but she had to take a couple of days off work to get the once over, few aches and pains, the usual stuff. She has lost a bit of money over this and obviously wants it back, she is not after thousands I might add, probably a couple of hundred.

This is where it gets tricky, the driver of her car won't give her the details of the car that hit them, they have obviously done a cash deal for the repair of her car. Friends girlfriend says fine then you pay my wages but still gets rebuffed.

Since she is being so awkward can my friends girlfriend claim of the insurance of the car she was in.

She would probably have to go to a no win no fee personal injury solicitor, but if its not reported and the people involved aren't reporting it I'm not sure how it would pan out.

From my understanding of how it works your friend can indeed claim off the insurance of the car she was in.

Indeed she can which would be amusing.

If she has the registration of the other vehicle she can obtain the Insurers details here for a small fee www.askmid.com she could also use this to obtain her friends Insurance details.

If there was an injury the police may be involved in which case they would have the other drivers details

Thats the problem, the driver won't even pass on the reg of the vehicle, let alone any insurance details she may have. Definitely no police involved, everyone just got on with their day after the crash, but the GF felt sick and went to the doctors apparently.

If it was me I'd probably just let it blow over, but on the other hand some people just need a lesson teaching to them the hard way.

I wouldn't waste time on it - you'll get up all worked up about it and she'll just let it go.

If the friends driver won't give details of his insurer or the other car, then I'd make it clear to him that you're going to report the matter to the police and that he'll then likely be "done" for failing to report an accident where there's an injury. The police are likely to interview him and he will have to give them the info which they should pass on to you as the injured party and you can take it from there. BTW your claim is against your friend's insurer, not the other cars insurer. Who's to blame is not for you to decide, it's your friend's insurer or the police.

I would guess he's being reticent because he doesn't want it to affect his NCD. that's not your concern, you've been injured while a passenger in his car and he'd liable for your losses.

I think it was another woman driving, she was giving her a lift to work as she does most mornings. Not sure of the gender of the car that actually hit the aggrieved car though, but if I had to guess I'd say that was a woman too.

Is she expecting to get a lift in future? Did she contribute costs for the lift?

She can claim off the insurance of either car. That'll leave them to argue it out amongst themselves. I'm assuming she can get the details of the insurance of the car she was in. All she needs is the registration number as above and head off to any No Win, No Fee solicitor.

She'll get her wages and other defined lossed plus around £1600 for the standard whiplash that the NWNF sols will find out she had, after a trip to their friendly medical company.

Tell the twonk that (s)he better hand over the details because if (s)he doesn't then her injuries claim company will be chasing them.

What does the fact that she is pregnant have to do with anything?

Because its a given that if you feel unwell then its straight to the docs or hospital. I would have carried on working with a sore shoulder or arm or whatever and suffered no loss.

Yes but us blokes do tend to ignore things and keep on going until our wives finally nag us into going to see a doctor.

It read to me like the usual claim to be deserving of a higher standard of - well - everything simply because 'pregnant.'

I wonder if the driver was insured for journeys to/from work.

OP all your friend needs to do is call one of the many ambulance chasing no-win no fee companies give them the details of the driver whose car she was in and sit back and wait for the cheque to appear.
