Evening All,

I've just received a debt enforcement notice from a baliff, relating to an unpaid council fine dated 8th Feb 2014 in respect of allegedly being in a bus lane.

I have never received any documentation from the council, so was unaware I was being fined. As its now over a year old the current cost is £172, no doubt significantly above the initial amount.

Do the debt enforcement company have a case? Do the council have a duty to show proof of postage re the fine? Does the likely fact that they have sold the debt to a baliff mean they will be totally uninterested?!

Advice please, you wise lot.

Pepipoo's "Council Parking Tickets & Clamping and Decriminalised Notices" forum; register and post your story there in a new thread (they will probably ask you to post up copies of all documents suitably washed of personal and other identifying details, but don't do that initially just tell a full history of what's happened so far in your first post smile ).

There is also the 'moneysavingexpert' website, which deals with this kind of thing as well.

Obviously misplaced beside the toilet roll and you accidently wiped your rear end with it

Dear AJ,

have you moved recently? Does the vehicle's V5 have your current address?
As aw suggests pepipoo is the place to go,

regards,
Jet

I did move relatively recently and delayed changing the address on the v5. Good point, I suspect the game is up. Balls.

If a DCA is after you it means you have not received any of the following:
- The PCN
- The Enforcement Notice
- The Charge Certificate
To get to that stage takes an absolute minimum of 56 days.

After that the next steps are
- Registration as a debt at Northampton CC and an Order for Recovery issued
- Warrant of Execution
The Order will take a further minimum of 14 days. A warrant 21 days after that.

I can only assume you did not use RM's mail forwarding service when you moved. Why?
Had you done so the failure to update your V5C promptly wouldn't have mattered a jot.

It's not expensive and that omission has cost you far more than you would have had to pay RM.
The occasional missive does go AWOL but it's rare and the chances of all of the above going astray are minuscule.
