I am wondering if some people could shed a bit of light on my current situation...

November last year, I was caught speeding in my van on a dual carriageway ( it would appear i should have only been doing 60 as its a light goods vehicle) as it was i got caught doing 69mph and so subsequently the NIP came through the post. I replied to this more or or less as soon as it arrived. However i didn't hear anything for a while afterwards but i spoke to various people and the general consensus was that the fixed penalty notice can sometimes take a little while to come.
So we are now into feb and i have received a court summons through the post, and the reason for this is apparently i didn't respond to FPN that they sent out on the 17th Nov. I rang the safety camera team and explained that i never received said FPN and therefore couldn't reply to it, i would have had no problem paying it as I'm aware i was in the wrong. I was half expecting the lady to say okay we will send you one out straight away and that i would have a set number of days to get it payed however she explained that i would still have to fill in the relevant documents for the courts. This all seems a bit harsh given its nothing i have done wrong and the last thing i want is a fine + court costs etc. I also spoke to the court itself and they said the same thing, that i would have to fill in the forms and just explain this in the mitigating circumstances section.

Has anybody had a similar experience or could somebody just point me in the right direction.

thanks

Wow. 69mph. This site is quite embarrassing as anyone who gets caught is only marginally over the speed limit and just in getting done territory.

I'm proud to say that last time I got caught was for 96.13moh.

Blimey - no sarcastic comment about people not receiving letters? You missed an opportunity to alienate yet another occasional poster.

What's the point. Nobody ever gets their post on here and nobody ever gets done for proper speeding either.

I've heard of similar things with various results - a colleague had the summons cancelled (at very short notice) and was able to go on a speed awareness course.

Others have had to go to court and got fined various amounts - some less than the fixed penalty, some the same and some more. They all had to pay the victim surcharge though.

The fact that you responded quickly to the NIP would hopefully help you.
