I'm a glazing man long story short firm I haven't used for around 16 months due to terrible service and products have out of the blue decided to get a Rottweiler debt company based in london to call write harass me claiming I owe £1300 .two other firms have done the same and I asked this question and both disappeared for around 9 months now I thought it was dead.
I have asked them to send copy of delivery notes as I have to sign for deliveries with all my suppliers and only have cod agreement with suppliers cheque to driver. Not sure how a c.o.d customer can or would be allowed to run up such a debt .i spend around £1000 a month on glass which is a shed load .debt guys say to me they don't need these as all they have to do is invoice me with what they say is a customer name and an invoice .debt firm have been in touch twice now and unbelievably arrogant! rude and have even put phone down on me .I wrote the request to them asking for delivery notes signed by me as sole director also the glass supplier was using a factoring company at the time and I agreed payments had to be to them but they quite often wanted payments made to them as and when they wanted also asked to pay cash and lose invoices I Regretably did.rang yesterday very abrasive threatening all sorts saying my letter was unreadable a joke I'm not great at writing but you can read it.i was threatened so much I put phone down mid way through their speal they tried to call 3 times more !

Any legal advice please what to do or are they just putting up a smoke screen I was going to rewrite letters useing huge letters and send a pair of glasses but thought I might stir up a hornets nest!! Help appreciated I could disclose on here the debt company but not sure if I'm allowed to!?

They can't get any money out of you legally until they take you to court and win.

If you've not had the items they say, then it's up to them to prove otherwise.

Tell them to take you to court if you've got nothing to hide.

To be fair I couldn't say either way as I have no invoices or delivery notes I might or might not have had units delivered I go through around 30 every week but without signed delivery notes which come with all my deliverys surely they have to produce my signature ?? If they are right they could invoice anybody for a delivery with no proof they where received .they state I have to give them my customers addresses and names going back to that time but surely they can't ask for that in any circumstance .i thought data protection would slaughter me for giving out that information?? Thankyou so far!

I can see their point around the legitimising of the letter you sent, if your opening post is anything to go by. I'm struggling to work out what's going on.

I can't tell from your post whether the glass supplier was using full factoring or invoice discounting. However I suspect it may have been full factoring in which case there is no way you should have been paying the supplier direct (with invoice discounting the supplier controls the ledger and collects the money which is then used to pay down the loan: the supplier's customer will not know that the sale to them is being financed).

It wouldn't be the first time a company has done dodgy stuff behind the factoring company's back. The 'cash under the counter/lose the invoice' aspect is further evidence of suspicious conduct. If I'm right you may well still owe the debt to the factors notwithstanding you have paid the glass supplier for the goods. In which case it won't be the supplier who has set the hounds on your trail, it will be the factoring company. Most of the players in the field are actually subsidiaries of the banks and they want their money back one way or the other.

OP all you need to is to deny the debt. They then have to go back to your supplier and cannot contact you again. If they do report them for harassment.
