Flights canceled, compensation?
Discussion
Hello,
We were due to fly to Rome for a three day break earlier in the month with Easyjet, the holiday was a present from the outlaws and was booked through a travel agent using a "Wowcher" deal, about 7 hours before departure we were informed by the travel agent the flights were cancelled due to a fire in the terminal at Rome airport, Easyjet had cancelled every other flight into Rome and ours happened to be one of them. Due to the amount of flights cancelled and the demand we were unable to get another flight that day (due to fly at 05:00) and would only get one later the following day, not this is obviously not good enough when we were only away for thee days in total.
The agent offered us a two day break in Magaluf
or three days in Naples but not within the time scale that we had planned, we had to plan this trip very carefully to work within both of our work holiday restrictions and commitments, and the biggest headache being child care for three days! In the end we got a full refund but only after a massive amount of arguing with the travel agent, so prehaps not the end of the world but needless to say a wasted holiday, wasted airport parking charges and generally a massive f
k around.
We had not really considered compensation for our losses and lack of holiday but then it turned out a week later Mrs Hoonigans brother went to go on exactly the same holiday (also a present) booked with the same company only to arrive at the airport to find the flights cancelled too! again exactly the same reason (airport fire) In their case Easyjet managed to get them on a flight 24 hours later put and them up in a hotel for the night, very good service all in all, they were then advised to claim compensation which they did, and received 500 Euro! Now in my eyes we should also be entitled to compensation for our losses and general inconvenience? however easyjet say other wise, they state that the airport was closed on H&S reasons and that no compensation needs to be paid, and wil not even consider our airport parking claim, f
kers... Despite us giving them my BIL's claim ref etc they will not entertain the fact there is any reason for them to pay us and just say they can't discuss other peoples claims
.
Does anyone have any experience of this sort of thing? do we have a leg to stand on?
Cheers

You should be reimbursed for any costs incurred as a result of the flight being cancelled and/or unnecessary costs (i.e. parking when it wasn't needed) however please jog on if you believe you're entitled to some form of compensation as a result of missing a holiday - almost like some kind of emotional distress plea.

A true PH response if there ever was one!
I didn't miss a holiday, it was cancelled! It has nothing to do with emotional distress but does have everything to with not getting the service I paid for, not being reimbursed for the parking and having taken two days annual leave to not go on holiday!
Yes we could have booked something else but this holiday was a present to us and until we got a refund (one week later) we did not want to spend £600 we had no intention of spending in the first place to find we we're not getting a full refund to cover it, especially as for the first two days the travel company were telling us they only were required to reimburse us for the outbound flight and nothing else!
I believe we could be entitled to compensation due my brother in law being informed by Easyjet that he was, and subsequently receiving it, and also because the CAA seem to think so too, the grey area is whether the airport was closed or not, I.e. Does halving the number incoming flights count as being closed?

As for the loss of two days' annual leave, boo-f
king-hoo. First world problems are a s
tter aren't they.Someone who receives EU261 for an airport fire is astonishingly lucky.
Assuming that the flight was cancelled as a direct result of the airport fire, that's classic 'extraordinary circumstances' and as long as you got your money back, you've been made whole.
The airline didn't cause the plane to be cancelled, the fire did. The airline certainly didn't guarantee that you'd have a great time when you got there. It's almost like asking for compensation if you happened to be unwell when you were there through no fault of the airline's.

OP - you have my sympathy but my advice is don't waste your life arguing the toss over this. I have had similar bad experiences with airlines and recently railways (London Midland) and they employ skilled "negotiators" to mitigate the airlines/railways losses and generally employ obfuscating tactics until you run out of energy - sort of creating the brick wall for you to bang your head against. Unless you are a skilled lawyer with a firm grasp of the law and enough time to put into practice you are better off quitting while you are ahead. Your relative was lucky to get his payment - if you have your money back that is a result! I am still writing letters and my head hurts!!
