£300,000 worth of damage £250 slapped wrist of a fine and the idiot driver wasn't even banned. judge

It was a company van so it won't even come out of his insurers pockets.

Completely ridiculous.

If you were or are a Police officer would you or have have you been tempted to arrest magistrates for Wasting Police Time?

If I was I bloody well would. cop

Can I presume from that that you were in court, and heard all the evidence presented?

No, thought not.

Back in February a driver was seen traveling at least 70mph in a 30 zone, he lost control and ploughed into the front of a listed building on an fairly straight section of road.

if the guy is that much of a menace on the road, he will get another 3 points and be banned in the not too distant future
if he is someone who made a couple of mistakes and one of them happened to have a very big impact, how is banning him from the road, which presumably would be a threat to his employment, going to make the world a better place

What sickens me about this is that my punishment for driving at 58mph on a DC at 3am was harsher than this.

NSL > 30mph limit, missed the sign and was flashed by a GATSO about 200m after the limit change. Not another car/human/animal in sight.

6pts, 250 fine and my licence revoked (22 months driving experience at the time).

What a fukcing joke.
What you did is far more serious than demolishing the front wall of someone's house.
I'm only surprised you didn't already know that. WElcome to broken Britain.

Quite. But you could make the same argument about the previous poster. Revocation in his case has exactly the same effect.

Well if his licence is revoked he will have to take his test again, this can only be a good thing as if he is that bad he demolished a house, an examination may pick up on similar faults.

Two if's so the first one. What if he kills someone next? Can the Magistrates in this case be arrested for accessories to Manslaughter?

Since the collision he has been seen driving like an idiot again so I have my doubts as to whether he has leaned anything.

I was asked my perspective and did a couple of Google maps and a summary. I have now asked if I can give details and been given the go ahead.

Approximately a quarter to nine on a dry overcast evening in February I was waiting at the end of Alma Chase to turn left on to Northgateway headed into my village. My nephew needed a lift to the shop before it closed at nine. There hadn't been any rain for days so the roads were bone dry, as it was overcast the temperature was six degrees Celsius and there was no chance of any ice. It was dark and everyone had headlights on but visibility was superb no signs of fog, mist or smoke. As I waited to turn left I observed a white Citroen Belingo van headed towards me from the right. I could tell by the way the headlights were bouncing on the road it was speeding and sure enough the amount of time it took to get to Alma Chase from where I first observed it was less than half the time I would expect a vehicle that was doing thirty. I turned to my nephew and said...

"There's an accident looking for somewhere to happen".

I pulled out of Alma Chase on to Northgateway and accelerated to thirty. I then slowed as a Vauxhall Astra was pulling out of Benns Lane further up. I flashed my lights so the driver knew he had time to complete the maneuver. I then went round Tower Corner where Nothgateway ends and Churchgateway begins back at thirty miles per hour. Passing the schools, Post Office and Scout hut I began to turn the next corner and noticed a commotion in the road further ahead. The same Citroen Blingo van I observed before was now parked in the front wall of what used to be the Angel pub opposite the church. I parked my car on the church car park, told my nephew to stay in the car, grabbed my first aid kit and hi-viz jacked from the boot and went to see if anyone needed any help.
First aid was already being addressed so I directed traffic until the emergency services arrived moments later and waited until an officer was available to give them this statement.

Because I did not witness the collision myself I was not asked to give evidence.

This limp wrist slap is basically giving bad drivers carte blanche to get away with what is basically demolition.

Even though I used this instance as an example my question was supposed to be more general and open.

Has any serving Police officer or member of the CPS ever felt like arresting a judge or magistrates for wasting Police time?

I don't know how you can do the job without wanting to repeatedly bang their heads against the wall. Because you do you have my many thanks. Keep up the good work even though magistrates and judges may make you question why you should bother.

All the best. smile

My priority was my first aid kit but my jacket was in the boot with it.

Don't tell I should have grabbed a camera or phone so I could post clips and photo's all over the internet later. rolleyes

No. This whole thread is weird though. I'm not sure if you've raised it to show your frustration at the leniency shown by the magistrates, your annoyance at the driver, the fact you were there soon after it happened or the fact that you got to play fake doctor.

The comment about getting "leave to post your statement" is ridiculous. Do you think you've signed the Official Sectets Act, or witnessed a serious breach of State security?

There is a massive difference between offering first aid if you are one of the first at the scene of a collision and playing doctor. I hope if you ever fall or are knocked off your R1 there is someone who is first aid trained and willing to help you. If an Ambulance is half an hour away it can be the difference between life and death.

When I crashed in 2007 a trained paramedic conveniently lived across the road and did a very good job. He didn't need to don his Hi Viz though and make a point of telling everyone that he did too.

So despite commenting on the weather, road conditions etc etc, the Op didn't actually see the collision then.

Oh I see. Sorry about that.

I mentioned what I was wearing in case another witness brought it up. The Police would know it was me and not waste time looking for someone else.

It does come across as a little pedantic as I read it back but it didn't as I wrote it. Good old misinterpretation of text. smile

The collision I caught on my dash cam' I waited until the case was ended before posting any information about it. It's the same principal here. I wanted to check before I went into any detail.

I get all of that and I understand the frustration. I had a girl demolish the hedge at the side of my house a few years ago whilst so pissed she couldn't stand up and she tried to drive off whilst the car was missing one of the front wheels. There is no issue posting stuff up about a case that's only ever going to be in a Mags Court, as you're unlikely to influence them. Even if it's Crown Court once it's been heard and is in the public domain you can post what the hell you want.

There is way too much fear about the law on here.

No. Between seeing the van blast past me and driving the two thirds of a mile to the collision scene the van had covered the distance, crashed into the house and the driver was out. It was less than five minutes. The detailing about the road conditions, visibility and weather are obvious.

Which brings me back to the point I'm trying to make.

The Mags have punished him as the see fit. That might not be as much as you ant, but PH is littered with stories like this and the flip side of those doing 31mph being banned for life.

What's wrong with that?

I carry the same based on experience of trying to cross 4 lanes of M25 to pull two people out of a smouldering car and also two other accidents I have stopped at where I have had to administer first aid.. try helping someone who has lost a, estimated later by doctors, litre of blood from a gaping head wound.

I always carry a big first aid kit and a couple of waterproof flouro jackets in the boot.
