Hi guys

I'll be brief with this, my partner is currently going through the process of claiming for injuries from a RTC a few years ago. Today she received a call from someone else in the same situation who had received a copy on my partners medical report attached to her own notes, name address, phone number etc which is very alarming.

First thing tomorrow when the solicitor who is dealing with is open she will be phoning up to complain, obviously there must be some sort of procedure for lodging a formal complaint with this.

  • what is the procedure?
  • is it worth actually pursueing? (the firm in question seem pretty useless)
amazing eh...a thread in here not about being caught over the speed limit

It is a breach of the DPA but in all likelihood is a basic admin mistake.

What do you wish to happen?

On the stuff..... what harm has been actually been done. Not might have been done, has been done ?

On the footnote quoted above....So you admit to being over the speed limit then?

damage, there is none we're not after compensation but the reports we've had from the bunch of cowboys have referred to my girlfriend as he/his they clearly are copying and pasting between records and updating.

This is the last in a long string of issues, we would rather say something than let it go unnoticed. The lady who received the paperwork was very concerned that her information may have been sent elsewhere aswell.

In your client take on form there should be details of the complaints process which is likely to be a written complaint to a specified director. Have a look at that.

If one really wanted to be fussy, the person whose insurance renewal details I got enclosed with mine could I suppose have sued the broker.

Except I did the decent thing, checked with the broker that they'd also sent the right stuff to the other party and destroyed the naughty bits. True I made a scan and OCR of part of the letters, but kept nothing that could identify car or driver. Reason I did that was because there were some bits of use to me (requirements associated with agreed value etc).

She needs to put it in writing, not verbally wink .

She also needs to garner the evidence from the other party who received "the info", arguably with a signed statement referring to receipt of said erroneous info from the person who received it? It's a long game - one needs to line one's ducks up/sets one stall out/refer to one's personal metaphor to getting it together ( wink ) - before complaining in the strongest posible terms...

Deal with this by phone? nono

She'll get nowhere wink - but it'll be fun to put the shcensoredts up 'em anywayhehe ; it wasn't an insurance company based in St Neots, was it?? scratchchin

She also needs to be sure she didn't leave ticked the box that says 'we want to share you details with other companies blah blah' or that it's not in the small print if this other party is trying to offer services

Contact the ICO, they will investigate properly and if they're a 'cowboy outfit' will be dealt with appropriately
