Landlord bills issue
Discussion
After a long time lurking in this forum I actually need its help.
I moved into a flat on 2nd April 2014 on a one year AST which then cycles into an ongoing one month tenancy.. It was agreed with the landlord that they would keep the power and water bills in their name but I would pay an additional £95 a month on the rent to cover this. I paid council tax myself. I have this in email from them.
In February this year all tenants in the block were advised that power bills will be changed into the tenants names. I queried this with the landlord via text and he told me disregard and mine would be changed when the initial AST was up in April. Arpil came and no word from them. In May I received a bill from EDF for £239.25 for the period of 10/02/2015 and 20/05/2015. I was annoyed I had to pay the February to April portion of the bill but did. I tried to get in contact with the landlord but the phone is never answered and emails and texts go unanswered.
Yesterday I recieved a bill from Thames Water for £640.85 for the period of 02/04/2014 to 31/03/2015.
And finally today a letter is received from the landlords new accounts firm claiming I owe the landlord £575.68 for power for the period of November 2014 to April 2015.
It seems the £95 a month I've been paying has not been going towards the bills.
What should I do? I need to pay the water bill now as it's in my name. Should I invoice that back to the landlord and get them to cancel the £575.68 they claim I owe them. Or pay and claim back the 13 months of £95 I've paid them (I've now changed the standing order to the original rent only amount).
A second issue with them. I have a large deposit, around £3250, which was in myDepoits scheme. After the original AST expired in April the deposit was removed and its no longer protected. Should it still be protected now I am in this one month rolling contract?
Thanks for any help in advance.

Haha not that I'm aware off there are no cables leaving my fuse box
Although the whole building has electrics that are not up to days code. We had a dodgy storage heater, electrician comes out and fixes it but says the fuse box is illegal. It cost the landlord £3k to fix it and I know the 5 other flats in this block have the old fuse boxes still!

Needs to be protected, you're entitled to up to three times the amount of the deposit if you take the landlord to court - discuss it with your local CAB branch?lewisco said:

The "one month rolling" is called a statutory periodic tenancy - and requires two full rent periods notice from the landlord, one from you. It's still the same tenancy, and your deposit MUST be protected in it by law.The fact he's pulled this daft stunt is very advantageous to you, if it all goes pear-shaped, because it means that any s21 notice the landlord gives you is invalid. It also allows you to sue for the return of up to three times your deposit.
The landlord being responsible for bills is unusual in an AST - normally, they're the tenant's responsibility - not least to prevent the landlord being left with a big bill because of a tenant doing a runner...
£640 for a year's water for a flat? <boggle>
One thing's for sure, you can't owe BOTH the landlord and EDF for electricity between Feb and April.

Updated original post. I moved in April 2014, last year. I've been paying an extra £95 for the last 14 months (I stopped paying as of this month) to cover these bills as agreed with the landlord the day after I moved in. Forums | Speed, Plod & the Law | Top of Page | What's New | My Stuff
